Justice M.SASIDHARAN NAMBIAR\n\n Dated :16\/02\/2010\n\n O R D E R\n             M.Sasidharan Nambiar, J.\n            --------------------------\n              Crl.M.C.No.357 of 2010\n            --------------------------\n\n                       ORDER\n<\/pre>\n<p>    Car KL-53\/A 141 was seized by the police in<\/p>\n<p>Crime No.1420\/2009 of Ernakulam Town South Police<\/p>\n<p>Station, registered for the offences under Sections<\/p>\n<p>39(b),  42,  44,   49(b)  and   51  of   Wild  Life<\/p>\n<p>(Protection) Act, 1972. Petitioner filed C.M.P.No.<\/p>\n<p>4898\/2009 under Section 451 of Code of Criminal<\/p>\n<p>Procedure   before   Additional    Chief   Judicial<\/p>\n<p>Magistrate&#8217;s Court (Economic Offences), Ernakulam<\/p>\n<p>for interim custody of the vehicle. By Annexure-A1<\/p>\n<p>order, learned Magistrate dismissed the petition<\/p>\n<p>holding that as the vehicle was allegedly used for<\/p>\n<p>transporting  ivory  tusks,  it  is  liable  to  be<\/p>\n<p>confiscated under Section 61A of Kerala Forest Act<\/p>\n<p>and therefore, the vehicle cannot be released to<\/p>\n<p>the  petitioner.  This  petition  is   filed  under<\/p>\n<p>Section 482 of Code of Criminal Procedure to quash<\/p>\n<p>Annexure-A1 order and to get the vehicle released.<\/p>\n<p><span class=\"hidden_text\">CRMC 357\/10              2<\/span><\/p>\n<p>    2. Learned counsel appearing for the petitioner<\/p>\n<p>and learned Public Prosecutor were heard.<\/p>\n<p>    3. Learned counsel, relying on the decision of<\/p>\n<p>this Court in <a href=\"\/doc\/523980\/\">Mohammed Ismail v. State of Kerala<\/a><\/p>\n<p>(2004 (3) KLT 322), argued that the Magistrate is<\/p>\n<p>competent to grant interim custody of the vehicle<\/p>\n<p>when the offences alleged are only under the Wild<\/p>\n<p>Life (Protection) Act, 1972 and confiscation of the<\/p>\n<p>vehicle would arise only on conviction of the<\/p>\n<p>accused for the said offences and hence, Annexure-<\/p>\n<p>A1 order is to be quashed.\n<\/p>\n<p>    4. Learned Magistrate dismissed the petition<\/p>\n<p>for  the   sole  reason that  as  the  vehicle  was<\/p>\n<p>allegedly used for transporting ivory tusks, it is<\/p>\n<p>liable to be confiscated under Section 61A of<\/p>\n<p>Kerala Forest Act.\n<\/p>\n<p>    5. Section 61A of Kerala Forest Act provides<\/p>\n<p>that   notwithstanding anything  contained  in  the<\/p>\n<p>foregoing provisions of the said Chapter, where a<\/p>\n<p>forest offence is believed to have been committed<\/p>\n<p><span class=\"hidden_text\">CRMC 357\/10                3<\/span><\/p>\n<p>in respect of timber, charcoal, firewood or ivory,<\/p>\n<p>which    is  the  property  of the Government,  the<\/p>\n<p>officer seizing the property under Section 52(1)<\/p>\n<p>shall, without any unreasonable delay, produce it,<\/p>\n<p>together with all tools, ropes, chains, boats,<\/p>\n<p>vehicles    and  cattle   used in  committing  such<\/p>\n<p>offence,    before  an  officer authorised  by  the<\/p>\n<p>Government in this behalf by notification in the<\/p>\n<p>Gazette.\n<\/p>\n<p>    6. Confiscation under Section 61A of Kerala<\/p>\n<p>Forest Act could only be in respect of a vehicle<\/p>\n<p>used for committing a forest offence. There is no<\/p>\n<p>case for the prosecution that any forest offence<\/p>\n<p>was committed. On the other hand, the vehicle was<\/p>\n<p>seized on the allegation that offences under Wild<\/p>\n<p>Life (Protection) Act were committed.<\/p>\n<p>    7.     Section 50 of Wild Life (Protection) Act<\/p>\n<p>provides for search, arrest and detention. Under<\/p>\n<p>sub-section (3), it shall be lawful for any of the<\/p>\n<p>officers referred to in sub-section (1) to stop and<\/p>\n<p><span class=\"hidden_text\">CRMC 357\/10                4<\/span><\/p>\n<p>detain any person, whom he sees doing any act for<\/p>\n<p>which a licence or permit is required under the<\/p>\n<p>provisions of the Act for the purpose of requiring<\/p>\n<p>such person to produce the licence or permit and if<\/p>\n<p>such person fails to produce the licence or permit,<\/p>\n<p>he could be arrested without warrant. Under sub-<\/p>\n<p>section (4), any person detained or things seized,<\/p>\n<p>under the foregoing power, shall forthwith be taken<\/p>\n<p>before the Magistrate to be dealt with according to<\/p>\n<p>law.\n<\/p>\n<p>    8.     Confiscation  provided under   Wild Life<\/p>\n<p>(Protection) Act is only under Section 51(2). Under<\/p>\n<p>Section 51(2), a court, trying the offence under<\/p>\n<p>this Act, upon conviction of the person under the<\/p>\n<p>Act, may order that the vehicle used for commission<\/p>\n<p>of the offence shall be forfeited to the State.<\/p>\n<p>Till   then,    it  is   not  the  property  of  the<\/p>\n<p>Government. If so, interim custody could be granted<\/p>\n<p>on   sufficient     conditions.  Therefore,  learned<\/p>\n<p>Magistrate was not justified in dismissing the<\/p>\n<p><span class=\"hidden_text\">CRMC 357\/10               5<\/span><\/p>\n<p>petition on the ground that the property is liable<\/p>\n<p>for confiscation under Section 61A of Kerala Forest<\/p>\n<p>Act.\n<\/p>\n<p>     Petition  is   allowed. Annexure-A1  order  is<\/p>\n<p>quashed.
