No.16875.10\n\n\n\n             Writ Petition No. 16875 of 2010\n16\/12\/2010\n      Shri Samdarshi Tiwari, learned Govt. Advocate\nfor the petitioner.\n      The petitioner by way of present petition seeks\nquashment of the award dated 18-12-2002 passed by\nthe   Labour    Court,   Bhopal,    and   the   order     dated\n31-07-2003 passed by the Industrial Court, Bhopal.\n      By the award dated 18-12-2002 the application\npreferred by respondent No. 1 under section 31 read<\/pre>\n<p>with section 61 of the Madhya Pradesh Industrial<br \/>\nRelations    Act,   1961,   has    been   allowed   and       the<br \/>\npetitioner has been directed to be classified on a<br \/>\npermanent post Junior\/Senior Binder and pay the<br \/>\ndifference of wages from 29-04-1998 whereas by<br \/>\norder dated 31-07-2003 passed by the Industrial<br \/>\nCourt, an appeal preferred by the petitioner herein<br \/>\nunder section 65 of the Act of 1961 has been<br \/>\ndismissed.\n<\/p>\n<p>      W hen the matter is taken up today, it is candidly<br \/>\nsubmitted that the Division Bench of this Court in a<br \/>\nsimilar petition, W rit Petition No. 2209\/04; Controller,<br \/>\nGovernment Printing and Stationary Press, Maida Mill<br \/>\nRoad, Bhopal vs. Smt. Rashida Bee and others, has<br \/>\naffirmed the award passed by the Labour Court while<br \/>\n                                                          W.P. No.16875.10<\/p>\n<p>dismissing the petition by order dated 11-12-2008. It<br \/>\nis further submitted that the said order has been<br \/>\nsubjected to challenge in a Special Leave to Appeal<br \/>\n(Civil) No. 13194\/09, wherein, the Supreme Court by<br \/>\nits    order      dated    09-07-2009       while     taking      into<br \/>\nconsideration the assurance of the learned senior<br \/>\ncounsel that the respondent shall not be removed<br \/>\nfrom service and status quo shall be maintained, has<br \/>\nissued notice.\n<\/p>\n<p>       In,      Controller,     Government          Printing      and<br \/>\nStationary Press, Maida Mill Road, Bhopal vs. Smt.<br \/>\nRashida Bee and others (supra) the Division Bench of<br \/>\nthis    Court      while    taking   into    consideration         the<br \/>\nsubmissions put forth by the learned counsel therein<br \/>\nobserved :\n<\/p>\n<blockquote><p>             &#8220;6.   W e have heard the learned counsel f or<br \/>\n             the parties and gone through the record. W e<br \/>\n             are not satis fied on the merits with the<br \/>\n             submission     raised    by  learned   Govt.<br \/>\n             Advocate, as in the reply filed by the<br \/>\n             employer it has been clearly admitted in<br \/>\n             paragraph- 8 that 150 posts were vacant and<br \/>\n             only 522 employees were work ing. Counsel<br \/>\n             has submitted that the employees have come<br \/>\n             from the Gas Relief and the unit was<br \/>\n             established      for    the    purpose     of<br \/>\n             accommodating them. However, the fact<br \/>\n             remains that there was availability of the<br \/>\n             vacant post which was not disputed in the<br \/>\n             reply filed by the employer, 150 posts were<br \/>\n             vacant, thus, no useful purpose would be<br \/>\n             served f or remitting the case to the labour<br \/>\n             court to give the finding on the aforesaid<br \/>\n                                                    W.P. No.16875.10<\/p>\n<p>        aspect. T he fact of vacancy being available<br \/>\n        admitted one, there has to be necessity of<br \/>\n        vacant post for the purpose of classification<br \/>\n        but in the instant case vacant posts were<br \/>\n        available even as per the reply filed by the<br \/>\n        employer. W ith respect to satisfactor y<br \/>\n        services being rendered by the employee,<br \/>\n        there is concurrent finding on facts recorded<br \/>\n        by the labour court and the Industrial court.\n<\/p><\/blockquote>\n<blockquote><p>        7.      Merely by the fact that initially the<br \/>\n        employees were engaged in Gas Relief<br \/>\n        Department , Bhopal and later on they were<br \/>\n        accommodated in the Govt. Printing Press,<br \/>\n        Bhopal, it would not be said that they were<br \/>\n        not entitled to be classified, they rendered<br \/>\n        their services for 11 years that too<br \/>\n        satisf actor y services, as standard standing<br \/>\n        order is clearly applicable to the such<br \/>\n        establishment,     relief  has   been  rightly<br \/>\n        grant ed. Having rendered the satisfactor y<br \/>\n        services for the requisit e period and due to<br \/>\n        availability of the vacant post, the right<br \/>\n        accrued to the respondent- employee to claim<br \/>\n        classification as permanent. The judgm ent<br \/>\n        relied upon by Shri Deepak Awasthy, GA in<br \/>\n        M.P. Housing Board &amp; another v. Manoj<br \/>\n        Shrivastava (supra), the availability of the<br \/>\n        vacancy has been made imperative and<br \/>\n        appointment should not be void. W e find that<br \/>\n        in the instant case there was availability of<br \/>\n        vacant posts and appointment was not<br \/>\n        shown to be void or illegal, thus, the<br \/>\n        decision does not help the case espoused by<br \/>\n        the petitioner.\n<\/p><\/blockquote>\n<blockquote><p>        8.    Consequently, we find there is no<br \/>\n        merit in the writ petition. Same is hereby<br \/>\n        dismissed. No costs.&#8221;<\/p><\/blockquote>\n<p>     In the case at hand since the challenge put forth<br \/>\nby the petitioner is to the orders similar to those as<br \/>\nwas subject matter of W rit Petition No. 2209\/04<br \/>\n(Controller,   Government      Printing    and    Stationary<br \/>\n                                              W.P. No.16875.10<\/p>\n<p>Press, Maida Mill Road, Bhopal vs. Smt. Rashida Bee<br \/>\nand others) and keeping in view the fact that the said<br \/>\norder has not been stayed, and in order to maintain<br \/>\nparity, we are of the considered opinion that the<br \/>\npresent petition is also liable to be dismissed on the<br \/>\nsame terms as W rit Petition No. 2209\/04 ( Controller,<br \/>\nGovernment Printing and Stationary Press, Maida Mill<br \/>\nRoad, Bhopal vs. Smt. Rashida Bee and others).\n<\/p>\n<p>     Accordingly, the petition fails and is hereby<br \/>\ndismissed.
