No.30084 of 2011\n                            Butan Singh son of Late Chand Badan Singh\n                                               Versus\n                                       The State Of Bihar\n                                             -----------\n<\/pre>\n<p>2.   14.9.2011                Heard learned Counsel for the petitioner and the<\/p>\n<p>                 State.\n<\/p>\n<p>                            The petitioner seeks bail in a case instituted for the<\/p>\n<p>                 offence under Sections 341, 323, 326 and 379 of the Indian<\/p>\n<p>                 Penal Code.\n<\/p>\n<p>                             Considering that no specific overt act is alleged<\/p>\n<p>                 against the petitioner, let the petitioner above named, be<\/p>\n<p>                 released on bail on furnishing bail bond of Rs. 5,000\/-(Five<\/p>\n<p>                 thousand) with two sureties of the like amount each or any<\/p>\n<p>                 other surety to be fixed by the court concerned to the<\/p>\n<p>                 satisfaction of learned Chief Judicial Magistrate, Bhojpur at<\/p>\n<p>                 Ara in connection with Udwant Nagar (Gajrajganj) P.S. Case<\/p>\n<p>                 No.192 of 2010, subject to the conditions (i) That one of the<\/p>\n<p>                 bailor will be a close relative of the petitioner who will give an<\/p>\n<p>                 affidavit giving genealogy as to how he is related with the<\/p>\n<p>                 petitioner. The bailor will undertake to furnish information to<\/p>\n<p>                 the Court about any change in address of the petitioner. (ii)<\/p>\n<p>                 That the bailor shall also state on affidavit that he will inform<\/p>\n<p>                 the court concerned if the petitioner is implicated in any other<\/p>\n<p>                 case of similar nature after his release in the present case<\/p>\n<p>                 and thereafter the court below will be at liberty to initiate the<\/p>\n<p>                 proceeding for cancellation of bail on ground of misuse, (iii)<br \/>\n<span class=\"hidden_text\">                                    -2-<\/span><\/p>\n<p>            That the petitioner will give an undertaking that he will receive<\/p>\n<p>            the police papers on the given date and be present on date<\/p>\n<p>            fixed for charge and if he fails to do so on two given dates and<\/p>\n<p>            delays the trial in any manner, his bail will be liable to be<\/p>\n<p>            cancelled for reasons of misuse, (iv) That the petitioner will be<\/p>\n<p>            well represented on each date if he fails to do so on two<\/p>\n<p>            consecutive dates, his bail will be liable to be cancelled.<\/p>\n<p>                     It has been submitted that the petitioner is an<\/p>\n<p>            accused in one complaint case except the present one, which<\/p>\n<p>            fact will be verified by the Magistrate concerned before<\/p>\n<p>            releasing the petitioner on bail.\n<\/p>\n<\/p>\n<pre>Narendra\/                        ( Anjana Prakash, J. )\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Butan Singh vs The State Of Bihar on 14 September, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
