Akhtar,Vivek Verma\n\nHon'ble Dilip Gupta,J.\n<\/pre>\n<p>The petitioner-Institution which is a minority Institution, running<br \/>\nthe B.Ed. Courses has filed this petition for quashing the<br \/>\nGovernment Order dated 15th October, 2009 issued for declaring<br \/>\nSession 2009-10 as Zero Session.\n<\/p>\n<p>It is contended by Sri Ashok Khare, learned Senior Counsel<br \/>\nappearing for the petitioner that the petitioner-Institution is a<br \/>\nminority Institution which has been taking admission in the past in<br \/>\nthe B.Ed. classes of its own and not from the list of the selected<br \/>\ncandidates from the Common Entrance Test conducted by the<br \/>\nUniversities and the Government Order dated 15th October, 2009<br \/>\nwhich has been issued under Section 28(5) of the Uttar Pradesh<br \/>\nState Universities Act, 1973 will not apply to the petitioner-<br \/>\nInstitutions as the minority institutions are exempted under the<br \/>\nAct. He has also placed reliance upon an interim order passed by<br \/>\nthe Division Bench of the Lucknow Bench of this Court in Writ<br \/>\nPetition No.11617 of 2009 which is as follows:-\n<\/p>\n<p>&#8220;Notice on behalf of the respondent no. 1, has been accepted by<br \/>\nthe learned Chief Standing Counsel and Sri Sandeep Dixit has<br \/>\naccepted notices on behalf of the respondents no. 2 and 3.\n<\/p>\n<p>The claim of the petitioner is that the present institution is a<br \/>\nminority institution, who has been taking admissions in the past,<br \/>\nand has taken admissions for B.Ed. classes of its own and not from<br \/>\nthe list of the selected candidates from the Common Entrance Test<br \/>\nconducted by the Universities and that the Government Order<br \/>\ndated 15.10.2009, which, in fact, amends Para -7, of the U.P.<br \/>\nState Universities (Regulation of Admission to Course of<br \/>\nInstruction for degree in Education in Affiliated, Associated and<br \/>\nConstituent Colleges), Order, 1987, would not come in their way<br \/>\nas the aforesaid order has been issued in exercise of the power<br \/>\nconferred on the State Government under Section 28 (5) of the<br \/>\nState Universities Act, which exempts its applicability to minority<br \/>\n institutions.\n<\/p>\n<p>Learned Counsel for the respondents could not justify the action of<br \/>\nthe respondents declaring zero session (academic session 2009-\n<\/p>\n<p>10) for such minority institutions as that of the petitioner.\n<\/p>\n<p>We, as an interim measure, provide that the students admitted by<br \/>\nthe petitioner institution in the present academic session shall<br \/>\ncontinue to study and the aforesaid order of 1987, as amended by<br \/>\nthe Government Order dated 15.10.2009, shall not come in its way<br \/>\nin getting the examination conducted for the academic session<br \/>\n2009-10.\n<\/p>\n<p>On the request of Sri D.K. Upadhyaya, let a counter affidavit be<br \/>\nfiled by the respondents within a period of three weeks and he<br \/>\nshall also provide details of other minorities institutions, who may<br \/>\nbe entitled for the same order so that multiplicity of writ petitions<br \/>\nbe avoided.\n<\/p>\n<p>List on 7.1.2010, as fresh.&#8221;\n<\/p>\n<p>He has also place reliance upon the interim order dated 7th<br \/>\nJanuary, 2010 passed by this Court in Writ Petition No. 70664 of<br \/>\n2009.\n<\/p>\n<p>Connect with Writ Petition No. 70664 of 2009.\n<\/p>\n<p>The matter needs to be examined.\n<\/p>\n<p>Learned Standing Counsel appears for respondent no.1.<br \/>\nRespondent no.2 is represented by Sri Vivek Verma while<br \/>\nrespondent no.3 is represented by Sri R.A. Akhtar. They pray for<br \/>\nand are granted four weeks&#8217; time to file the counter affidavit.<br \/>\nRejoinder affidavit, if any, may be filed within two weeks&#8217;<br \/>\nthereafter.\n<\/p>\n<p>List this petition for admission\/hearing immediately after the<br \/>\nexpiry of the aforesaid period.\n<\/p>\n<p>In the present case, as the petitioner-Institution has not taken<br \/>\nadmissions to the B.Ed.
