Justice M.SASIDHARAN NAMBIAR\n\n Dated :13\/12\/2010\n\n O R D E R\n          M.SASIDHARAN NAMBIAR,J.\n\n           ---------------------------------------------\n           CRL.M.C.NO.4241 OF 2010\n           ---------------------------------------------\n           Dated 13th December, 2010\n\n\n                          O R D E R\n<\/pre>\n<p>          Petitioner, the accused in Crime<\/p>\n<p>No.18\/2010 of Kunnamangalam Police Station<\/p>\n<p>filed this petition under Section 482 of<\/p>\n<p>Code of Criminal Procedure to quash the<\/p>\n<p>crime  registered            against             him      for   the<\/p>\n<p>offence under Section 376 of Indian Penal<\/p>\n<p>Code and Section 67 and 72 of Information<\/p>\n<p>Technology   Act,          contending                that    entire<\/p>\n<p>disputes   with           the          third            respondent,<\/p>\n<p>prosecutrix has been settled and consequent<\/p>\n<p>to the settlement, the case                              is to be<\/p>\n<p>quashed.\n<\/p>\n<p>       2. Second                 respondent                appeared<\/p>\n<p>through  a    counsel             and        filed        a  joint<\/p>\n<p>petition seeking permission                           to compound<\/p>\n<p>Crmc 4241\/10<br \/>\n<span class=\"hidden_text\">                          2<\/span><\/p>\n<p>the offence.\n<\/p>\n<p>            3.  Learned  counsel appearing for the<\/p>\n<p>petitioner,      second  respondent  and   learned<\/p>\n<p>Public Prosecutor     were heard.<\/p>\n<p>            4. Offence under Section 376 of Indian<\/p>\n<p>Penal      Code is  not  compoundable.  Therefore,<\/p>\n<p>permission cannot be granted to compound the<\/p>\n<p>offence. Then the question is whether based on<\/p>\n<p>the settlement, offence under Section 376       of<\/p>\n<p>Indian Penal Code is quashed.<\/p>\n<p>            5. If  based  on   the  settlement  or<\/p>\n<p>affidavit filed by the prosecutrix, an offence<\/p>\n<p>under Section 376 is to be quashed, possibility<\/p>\n<p>of threatening the prosecutrix and procuring<\/p>\n<p>settlement     cannot  be  ruled out.  It  is  not<\/p>\n<p>conducive for proper administration of criminal<\/p>\n<p>justice      system.  More  over,   offence  under<\/p>\n<p>Section 376 of Indian Penal Code is not purely<\/p>\n<p>Crmc 4241\/10<br \/>\n<span class=\"hidden_text\">                         3<\/span><\/p>\n<p>an    offence   against the prosecutrix,  but  an<\/p>\n<p>offence      against  the    society.   In  such<\/p>\n<p>circumstances, case cannot be quashed as sought<\/p>\n<p>for.
