On perusal of the<br \/>\n     affidavit-in-reply filed by respondent No.6 it clearly<br \/>\n     transpires that, for the same subject-matter, Special<br \/>\n     Civil Applications Nos.412 of 1996 and 4602 of 1996 were<br \/>\n     also filed by villagers of the same village and that<br \/>\n     these petitions came to be withdrawn unconditionally.<br \/>\n     Copies of such orders are produced at pages 126 and 129.<br \/>\n     Special Civil Application No.412 of 1996 was filed by<br \/>\n     Kanubhai   Kubhabhai Vagh and three others and were<br \/>\n     represented by learned Advocate Mr. A.J.Shastri whereas<br \/>\n     Special Civil Application No.4602 of 1996 was filed by<br \/>\n     Devayat Mansi Vala and four others and were represented<br \/>\n     by Mr.   P.N.Bavishi.    Both these petitions came to be<br \/>\n     withdrawn unconditionally. The present petitioners have<br \/>\n     denied their relationship with the petitioners of earlier<br \/>\n     two petitions but, on perusal of documents, it appears<br \/>\n     that all the persons are closely related and connected<br \/>\n     with each other and the present petition is also filed in<br \/>\n     collusion with each other. Thus, the act of petitioners<br \/>\n     in initiating proceedings one after another either under<br \/>\n     one or other pretext, form and before forum is a clear<br \/>\n     abuse of process of court. Moreover, the contents of the<br \/>\n     petition run counter to the documentary evidence produced<br \/>\n     on record by respondent No.6.     During the course of<br \/>\n     arguments, Mr.    Bavishi has made a statement before the<br \/>\n     court that the petition is filed keeping in mind the<br \/>\n public interests and the petitioners do not have any<br \/>\npersonal interests except right of grazing cattles.    It<br \/>\nis also made clear by Mr.Bavishi that none of the<br \/>\npetitioners claims any right of possession, occupation or<br \/>\nhas caused any encroachment on the land in question.<br \/>\nDespite this statement, Civil Suit No.1 of 1997 filed on<br \/>\n1.1.1997 clearly suggests that closely related persons of<br \/>\nthe petitioners claim right of possession qua the land in<br \/>\nquestion and prayed for protection against respondents.<br \/>\nIt further suggests that the petitioners and companions<br \/>\nare bent upon to abuse the process of court with ulterior<br \/>\nmotive and to circumvent the object for which Resolution<br \/>\nwas passed by the Panchayat on 5.6.1991 and consequential<br \/>\norder by the Government through Mining Department, on<br \/>\n7.2.1995 followed by execution of lease agreement on<br \/>\n2.2.1996.   The evidence on record is so eloquent that<br \/>\nsome of the signatories of resultion as member of<br \/>\nPanchayat have also initiated proceedings only to suggest<br \/>\nulterior motive.\n<\/p>\n<p>2.Thus, since the petition on the face of it<br \/>\nappears to have been filed with ulterior motive, does not<br \/>\nwarrant   exercise   of    extraordinary    discretionary<br \/>\njurisdiction and deserves rejection.      With a view to<br \/>\ndiscourage abuse of process of court, in my view, such<br \/>\nrejection should be coupled with exemplary costs, hence I<br \/>\npass the following order;\n<\/p>\n<p> Petition is rejected. Each of the petitioners is<br \/>\n        directed to pay Rs.2,000\/- (rupees two thousand)<br \/>\n        as costs within two weeks from today failing<br \/>\n        which the Collector of Junagadh is directed to<br \/>\n        recover the same as arrears of land revenue.
