The\n\nmatter has been settled and a compromise petition has been filed.\n\nThe Compromise petition will form part of the Award. No amount is\n\ndue to the respondent. The documents received from the lower court\n\nand produced in A.S.572\/2002 will be returned to the appellant's\n\ncounsel as early as possible.     All appeals were filed as indigent.\n\nTherefore, in view of the fact that the matter is settled, no court fee is\n\npayable in the light of the decision in A.S.222\/1995 dated 4th August,\n\n1995. This petition is filed under Section<\/p>\n<p>482 of Code of Criminal Procedure to quash the<\/p>\n<p>proceedings as against the petitioners contending<\/p>\n<p>that second respondent is not an aggrieved person<\/p>\n<p>and her husband is not impleaded in the petition<\/p>\n<p>before the Magistrate and second respondent is not<\/p>\n<p>entitled to claim a residential order in respect of<\/p>\n<p>the property of the petitioners and therefore, the<\/p>\n<p>case as against them is to be quashed.     Reliance<\/p>\n<p>was placed on the decisions of the Apex Court in<\/p>\n<p><a href=\"\/doc\/594165\/\">S.R.Batra v. Taruna Batra<\/a> ((2007) 3 SCC 169) and<\/p>\n<p><a href=\"\/doc\/913087\/\">Vimalben  Ajitbhai  Patel  v.  Vatslaben  Ashokbhai<\/p>\n<p>Patel<\/a> (2008 (2) KHC 396).\n<\/p>\n<p><span class=\"hidden_text\">CRMC 2385\/09               2<\/span><\/p>\n<p>     2.    On hearing the learned counsel, I find no<\/p>\n<p>reason to interfere with the proceedings pending<\/p>\n<p>before the learned Magistrate in exercise of the<\/p>\n<p>powers    under  Section  482  of  Code  of  Criminal<\/p>\n<p>Procedure.
