Gadhia for the petitioner.  The learned<br \/>\nadvocate for the petitioner submitted that the learned Judge of the<br \/>\nLabour Court has committed an error in not awarding reinstatement,<br \/>\nthough, the learned Judge has believed that there is breach of the<br \/>\nprovisions of labour laws.  In the alternative, he submitted that the<br \/>\nlearned Judge has erred in awarding too a meagre an amount as lump<br \/>\nsum compensation in lieu of reinstatement.  By award and order dated<br \/>\n5th January 2010, the learned Judge of the Labour Court,<br \/>\nMahesana in Reference No. 17 of 2008 (Old No. 217 of 1994) has<br \/>\nawarded only Rs.10,000\/- as lump sum compensation.\n<\/p>\n<p>2.0\tThe<br \/>\nmatter requires consideration.  Hence, Rule.  Learned advocate<br \/>\nMr. HS Munshaw for the respondent waives service of Rule.\n<\/p>\n<p>2.1\tOn<br \/>\na request made by learned advocate for the petitioner, the matter is<br \/>\ntaken up for final hearing, to which, the learned advocate for the<br \/>\nrespondent has no objection.\n<\/p>\n<p>3.0\tAs<br \/>\nthe matter is restricted to quantum of lump sum compensation, taking<br \/>\ninto consideration the fact that the petitioner &#8211; workman had<br \/>\nworked for about two years, as the learned Judge of the Labour Court<br \/>\nhas believed that, which is not admitted by the learned advocate for<br \/>\nthe respondent and taking into consideration the length of service<br \/>\nand the fact that the petitioner &#8211; workman is not awarded<br \/>\nreinstatement, the amount of lump sum compensation is enhanced to<br \/>\nRs.35,000\/- (Rupees Thirty five thousand only).\n<\/p>\n<p>3.1\tWith<br \/>\nthis direction, the petition is partly allowed.  Rule is made<br \/>\nabsolute to the aforesaid extent.  No order as to costs.\n<\/p>\n<p>3.2\tAt<br \/>\nthe request of learned advocate for the petitioner, the respondent is<br \/>\ndirected to pay this amount as early as possible but not later than<br \/>\n30th September 2011.\n<\/p>\n<p>3.3\tLiberty<br \/>\nis reserved in favour of the petitioner in case of difficulty.\n<\/p>\n<p>[<br \/>\nRavi R.
