5\/d’efen_’dant’s for specific performance of an agreement to<\/p>\n
 dated 16.03.2009 in respect of piaint schedule<\/p>\n
“property for sale consideration amount of Rs.4,67,500\/-.<\/p>\n
   No.2 was filed along with the suit under Order 39 Rule<\/p>\n
ix<\/p>\n
1 & 2 of CPC to pass an order of temporary injunction. Suit<\/p>\n
summons and notice of the LA was ordered :to’\u00bb..the<\/p>\n
defendants on 24.04.2009. Simultaneously,~\u00ab~~-theQcoioirtg<\/p>\n
decided to hear on stamp duty on the next.,d,a_te,Vvof_]heai’il’ng_ <\/p>\n
of the suit. Defendants though’ w:eAre:,s\u00abertie’d…:<\/p>\n
summons, did not appear and hence, they5lw.e’re plgacedt<\/p>\n
exparte. However, on 03.0\u20ac\u00a7’.i’2V009_, def’e.n”dantsl\\appeared
\nand filed I.A No.4 un’d:er.Ori:ler:, CPCV2u”tox set-aside
\nthe order dated 02.0\u00a7.V2l’009l.t’__Vp{aciiigtliem exparte and<\/p>\n
permit themftlo’f5p’roseCute””the’  No.4 was not<\/p>\n
opposedijy plainti:ff.a’i1d  the same was allowed.
\nThe pvlxalnltiff  filed compromise petition<\/p>\n
under_Order. 23.Ri–ile’-.3’\u20ac:PC. The trial court noticed from<\/p>\n
“‘~..,_’the-,i{T;fJ,:that,  property is a granted land by the<\/p>\n
 the 15’ defendant, who belonged to<\/p>\n
l(oracha_ a scheduled tribe, with a nonralienation<\/p>\n
condition. of 15 years. A memo was filed stating that, the<\/p>\n
“:l.”_pos’s’ession of the property is with the defendants only and<\/p>\n
 the plaintiff has not taken the possession as per the<\/p>\n
agreement and the recital in the sale agreement that the<\/p>\n
la.\n<\/p>\n

court heard the learned counsel and adjourned  V.<\/p>\n

Viiacting _vu.indef\u00abSection 33 of The Karnataka Stamp Act, 1957<\/p>\n
 has ordered for impounding of the<\/p>\n
deed.  the next hearing date, the plaintiff filed a memo<\/p>\n

amount towards the deficit stamp duty and penalty as<\/p>\n
required under Section 37(1) of the Act, in <\/p>\n

been held to be opposed to public policy and void, the<\/p>\n
order directing impounding of the document <\/p>\n
Thirdly, on account of the fact that the partiesihavei <\/p>\n

16.03.2009, there was no need  trial’ court\u00ab.<\/p>\n

penalty and in ordering the impounding of the<\/p>\n

not duty stamiqedf Section 33 casts a duty upon every<\/p>\n
.\u00b0’ipersoniwhohas authority to receive evidence and every<\/p>\n
 of a pubiic office before whom the<\/p>\n

has the recital of delivery of possession of_  <\/p>\n

“That as per the agreensier1=t’d’of_saiedatecl 16303-2009
\nthe plaintiff was,_put  posisessioh of the
\nproperty and      in peaceful
