ear*n__ing_.ee.pacity at 15% in one case and 10% in the other<\/p>\n

claimants are concerned, the submission of the” ClaiII:ar1.ts”–_<\/p>\n
counsel is that the percentage.to.lof loss ‘of eeariaing capacity it<\/p>\n
taken by the Commis’sionerVAl”i’s’Aon llith\ufb01e lovver ‘side while
\ncompared to the medical .c_eivildenc:e   the claimant<\/p>\n
and consequen..’tly’–the \ufb01jincolme ot”~.th.e Claimant Khasim was<\/p>\n
taken on aliiovver \ufb01ignrelthotigh. he was a driver and so also<\/p>\n
in the case ‘of other <\/p>\n
V  V.  I-Iavinlgthtis heard both sides and taking note of<\/p>\n
 the ‘con’teVntion_s'”_urged as above, so far as the assessment of<\/p>\n
earning _capacity percentage is concerned, no doubt the<\/p>\n
respective claimants did not suffer any fracture but that<\/p>\n
icioellsgnot mean that the injury caused to them did not cause<\/p>\n
 any disability to the respective claimants. The doctor-<\/p>\n

A.S.Dani, who was examined, has deposed that so far as<\/p>\n
Khasim is concerned, there is pain and swelling onvtheiiimb<\/p>\n
region and continuous pain at the back of the \u00ab _<\/p>\n
spread to sciatic nerve and therefore the said–p.ati.ent::iinds itw. <\/p>\n
difficult to bend his chest  <\/p>\n

all these facts into consideratiornthe Doc.to:r’vhas\u00a5\u00a7aSsesSed
\nthe earning capacity  .\\,’iin..caseiHHofii claimant
\nBheemaiingappa, the  t}geit” ‘said patient had
\ndifficult t0 br\u20ac:i*:l4tiii1″\u00a7i-i1orri’1a1i3;r  pain and he also
\nhad right    iir’es’tricted on account of
\n  from earning point
\nof viewziaround’ The Commissioner, after taking<\/p>\n
notegof the above .e.Vidence:of the Doctor and also having had<\/p>\n

 it fit to reduce the earning capacity<\/p>\n
percentage ‘:ii(3′;:l5\u00b0\/0 in respect of Khasim and 10% in respect<\/p>\n
 of oth*e_r’c1aimant Bheemalingappa. The said \ufb01nding of the<\/p>\n
V’ Commissioner being purely on \ufb01nding of fact, no substantial<\/p>\n
question of law arises as regards the said \ufb01nding.<\/p>\n
