Justice J.M.JAMES\n\n Dated :13\/07\/2006\n\n O R D E R\n                            J.M.JAMES, J.\n                              --------------\n                           B.A.4161\/2006\n                            ------------------\n      DATED THIS THE 13TH DAY OF JULY, 2006\n\n\n                              O R D E R\n<\/pre>\n<p>             The petitioners 1 to 3 are the accused 4, 5 and<\/p>\n<p>6,   in   crime   No.438\/2006   of   Kasargode   Police   station,   in<\/p>\n<p>which,   they   along   with   others   are   alleged   to   have<\/p>\n<p>committed the offence punishable under Sections 384 and<\/p>\n<p>120(b)   IPC.     It   is   alleged   that   on   25.5.2006,     the   first<\/p>\n<p>accused made a telephone call from Sharja, informing the<\/p>\n<p>defacto   complainant,     that   her   son,     Mehaboob,     was<\/p>\n<p>involved in a road traffic accident and therefore, to meet<\/p>\n<p>the damages, he had caused the complainant and has to<\/p>\n<p>pay Rs 6,00,000\/-.   However,   consequent on the threat,<\/p>\n<p>over the telephone, and demand  made by the petitioners,<\/p>\n<p>an amount of rupees two lakhs had been  extorted from the<\/p>\n<p>defacto complainant.  The defacto complainant, the mother<\/p>\n<p>of   Mehaboob,   made   a   complaint   and   a   crime   had   been<\/p>\n<p>registered as above.  The petitioners are before this Court,<\/p>\n<p>under Section 438 Cr.P.C.\n<\/p>\n<p>      2.     Heard both sides.   After appreciating the facts<\/p>\n<p>that   are   placed   before   me,   and   on   going   through   the<\/p>\n<p>C.D.file, including the fact that the accused 1 and 2 had<\/p>\n<p>B.A.4161\/2006<br \/>\n<span class=\"hidden_text\">                                   2<\/span><\/p>\n<p>already been interrogated and released on bail, I direct<\/p>\n<p>the   petitioners   to   surrender   before   the   investigating<\/p>\n<p>officer   of   Kasargode   Police   Station,     on   20.7.2006<\/p>\n<p>between   10.00   a.m   and   11.00   a.m.     The   investigating<\/p>\n<p>officer shall interrogate the petitioners, accused, 4, 5 and<\/p>\n<p>6,   and   thereafter,   produce   them   before   the   Judicial<\/p>\n<p>Magistrate of First Class, Kasargode,   as per the law.   I<\/p>\n<p>make it clear that if the investigating officer needs the<\/p>\n<p>petitioner for continued interrogation,   in excess of the<\/p>\n<p>period   permitted   by   law,     he   is   free   to   move   an<\/p>\n<p>application before the Court below, in which event, the<\/p>\n<p>learned   Magistrate   shall   hear   both   sides     and   pass<\/p>\n<p>orders.     If   on   the   other   hand  the   petitioners   move   an<\/p>\n<p>application   for   bail,     the   learned   Magistrate   shall   also<\/p>\n<p>hear the same along with other application,  if any, filed<\/p>\n<p>by the prosecution, and pass orders on merit.
