No. II-3073\/10, filed<br \/>\nbefore DCB Crime Police Station, Ahmedabad, for the offence<br \/>\npunishable under Section-25(1) of the Arms Act.\n<\/p>\n<p>2.\t\tLearned<br \/>\nCounsel for the petitioner submitted that the petitioner has a valid<br \/>\nlicense for the gun, which is renewed till 16.01.2013.  It was, this<br \/>\nvery weapon for which the petitioner is holding the license, which<br \/>\nwas allegedly found from the original accused No.1. He has been<br \/>\nreleased on bail by the Sessions Court. The petitioner has no<br \/>\ncriminal antecedents. The gun was not used in any illegal activities.\n<\/p>\n<p>3.\t\tI<br \/>\nhave perused the contents of the complaint, prima<br \/>\nfacie,<br \/>\nconsidering the same and also the fact that the petitioner has no<br \/>\nother criminal antecedents, it is ordered that in the<br \/>\nevent of arrest of the petitioner, in connection with C.R. No.<br \/>\nII-3073\/10, filed<br \/>\nbefore DCB Crime Police Station, Ahmedabad, he<br \/>\nshall be RELEASED on anticipatory bail, upon his<br \/>\nfurnishing a bond of Rs. 25,000\/-(Rupees Twenty Five<br \/>\nThousand) with one surety of the like amount, to the satisfaction of<br \/>\nthe lower Court and subject to the conditions that he,<\/p>\n<p>[A]\tshall<br \/>\nCOOPERATE with the investigation and make himself<br \/>\navailable for interrogation whenever required;\n<\/p>\n<p>[B]\tshall<br \/>\nremain PRESENT at the concerned Police Station  on 4TH<br \/>\nFEBRUARY, 2011, between 11:00 a.m. to 2:00 p.m.;\n<\/p>\n<p>[C]\tshall<br \/>\nNOT hamper the investigation in any manner nor shall<br \/>\ndirectly or indirectly make any inducement, threat or promise to any<br \/>\nwitness so as to dissuade him from disclosing such facts to the Court<br \/>\nor to any Police Officer;\n<\/p>\n<p>[D]\tshall,<br \/>\nat the time of EXECUTION of bond, furnish<br \/>\nthe ADDRESS to the Investigating Officer and the Court<br \/>\nconcerned and shall NOT CHANGE the residence till the<br \/>\nfinal disposal of the case or till further orders;\n<\/p>\n<p>[E]<br \/>\n\tWILL NOT leave INDIA without the prior<br \/>\npermission of the Court and, if is holding a PASSPORT,<br \/>\nshall SURRENDER the same before the trial Court<br \/>\nimmediately;\n<\/p>\n<p>[F]\tIt<br \/>\nwould be open to the Investigating Officer to file an application for<br \/>\nREMAND, if he considers it just and proper and the<br \/>\nconcerned Magistrate would decide it on merits;\n<\/p>\n<p>[G]\tThis<br \/>\norder will be operative if the applicant is arrested, at any time,<br \/>\nwithin a period of 90 days from, TODAY;\n<\/p>\n<p>[H]\tWithin<br \/>\na period of TEN DAYS from the date of arrest, the<br \/>\napplicant shall apply for REGULAR BAIL which<br \/>\napplication shall be decided by the competent Court in accordance<br \/>\nwith law WITHOUT being INFLUENCED by the<br \/>\nfact that anticipatory bail was granted.\n<\/p>\n<p>4.\t\tRule<br \/>\nis made absolute.
