Whether the judgment should be reported in the Digest?\n\n\n\nPresent:   Mr.Harsh Aggarwal, Advocate,\n           for the petitioner.\n\n           Mr.Yashwinder Singh, AAG, Haryana,\n           for the State.\n\n           Mr.Rahul Rathore, Advocate,\n           for the complainant.\n\n                   *****\n\nRANJIT SINGH, J.\n<\/pre>\n<p>           The petitioner has filed this petition for quashing of order<\/p>\n<p>dated 15.10.2004 (Annexure P-5) passed by Judicial Magistrate Ist<\/p>\n<p>Class, Faridabad and order dated 13.1.2005 (Annexure P-6) passed<br \/>\n<span class=\"hidden_text\"> Criminal Misc.-M No.24687 of 2005                      :2:<\/span><\/p>\n<p>by Addl.Sessions Judge, Faridabad.\n<\/p>\n<p>            Vide Annexure P-5, the prayer of the petitioner for dis-<\/p>\n<p>allowing Shri Mahesh Chand Sharma, Advocate from representing<\/p>\n<p>the complainant and for participating in the trial has been declined on<\/p>\n<p>the ground that the same is not maintainable. Through order,<\/p>\n<p>Annexure P-6, the prayer of the petitioner for his discharge is<\/p>\n<p>rejected and so he has filed the present petition under Section 482<\/p>\n<p>Cr.P.C. to impugn the said orders.\n<\/p>\n<p>            Learned counsel representing the petitioner could not say<\/p>\n<p>anything substantial to impugn the order whereby his prayer to debar<\/p>\n<p>an Advocate to represent the complainant has been declined. He<\/p>\n<p>also could not point out to any provision of law whereby such an<\/p>\n<p>application can be maintained seeking to debar a counsel to<\/p>\n<p>represent his opposite party. No reasons otherwise are disclosed in<\/p>\n<p>the application or in the order for which this prayer was filed.<\/p>\n<p>            The petitioner had prayed for his discharge only on the<\/p>\n<p>ground that investigation in this case was directed to be verified by<\/p>\n<p>the gazetted officer before submission of challan by this court, which<\/p>\n<p>has not been done and hence the petitioner deserves to be<\/p>\n<p>discharged. This court on 30.4.1997 had disposed of Criminal<\/p>\n<p>Misc.Petition No.9239-M of 1997 with the following observations:-<\/p>\n<blockquote><p>            &#8220;Present petition stands disposed of with the directions to<\/p>\n<p>            the State that the Investigation of the F.I.R. No.338 dated<\/p>\n<p>            18th March, 1997 under Sections 406, 420, 506 I.P.C.<\/p>\n<p>            registered in Central Police Station, Sector 15, Faridabad<\/p>\n<p>            must be verified by a Gazetted Officer, before the<\/p>\n<p>            submission of the challan.&#8221;<\/p><\/blockquote>\n<p>\n<span class=\"hidden_text\"> Criminal Misc.-M No.24687 of 2005                     :3:<\/span><\/p>\n<p>           The conceded position is that zimni Nos.50 to 71 were<\/p>\n<p>verified by Shri Balbir Singh Baniwal, DSP. The grievance of the<\/p>\n<p>petitioner is that zimni from 72 to 91 were not so verified and thus the<\/p>\n<p>challan, which has been submitted, cannot be termed as having been<\/p>\n<p>verified by the gazetted officer. It is further pointed out that for this<\/p>\n<p>very reason, the then Addl.Chief Judicial Magistrate, Faridabad had<\/p>\n<p>directed fresh investigation, but still the challan has been re-<\/p>\n<p>submitted against the petitioner. Concededly, the challan has been<\/p>\n<p>re-submitted on the report of DSP (Headquarters) dated 30.11.2002.<\/p>\n<p>The order impugned has been passed by Addl.Sessions Judge,<\/p>\n<p>Faridabad before whom the order dated 15.10.2004 was under<\/p>\n<p>challenge. Judicial Magistrate Ist Class, Faridabad had only<\/p>\n<p>observed in his order that question in regard to his discharge would<\/p>\n<p>be disposed of at the time of argument on charge along with the<\/p>\n<p>other accused. Against this order, the petitioner had filed a revision,<\/p>\n<p>which was held not to be maintainable as the order impugned was an<\/p>\n<p>interlocutory order. Addl.Sessions Judge, Faridabad was right in<\/p>\n<p>observing that trial court should expeditiously deal with the case<\/p>\n<p>since it has been registered as back as on 18.3.1997. The grievance<\/p>\n<p>of the petitioner is really not understood. The only direction issued by<\/p>\n<p>this court was that the gazetted officer was to verify the investigation.<\/p>\n<p>There was no direction that gazetted officer was to sign the zimnis.<\/p>\n<p>As can be discerned from the orders, the challan against the<\/p>\n<p>petitioner has been submitted on a report of DSP (Headquarters) and<\/p>\n<p>hence no violation of any order is seen. Interference in the method<\/p>\n<p>and manner of investigation by the court generally is not called for<\/p>\n<p>and as such I do not see any infirmity in the orders impugned in the<br \/>\n<span class=\"hidden_text\"> Criminal Misc.-M No.24687 of 2005            :4:<\/span><\/p>\n<p>present petition. To me, it seems to be misconceived.
