Counsel for the petitioner has \tsubmitted that<br \/>\nthis petition is exactly identical to Special \tCivil Application No.<br \/>\n1902 of 1997. Rule. Notice as to \tinterim relief returnable on 28th<br \/>\nJanuary, 1999. To be \theard with Special Civil Application No.<br \/>\n1902\/1997.\n<\/p>\n<p>2.0\tIt<br \/>\nis required to be noted that the Special Civil Application No. 1902<br \/>\nof 1997 is disposed of by this Court ( Coram: MS. JUSTICE R.M.<br \/>\nDOSHIT) vide order dated 18.09.2006 which is reproduced as under:\n<\/p>\n<p> \t Heard the learned advocates.\n<\/p>\n<p>\tThe<br \/>\npetitioner, a former employee of the respondent-District \tPanchayat,<br \/>\nSurat [hereinafter referred to as,  the District\tPanchayat ]<br \/>\nseeks reinstatement and regularization in\tservice.\n<\/p>\n<p>It is not in dispute that the petitioner was appointed by<br \/>\nthe\tExecutive Engineer, Roads &amp; Building Department,<br \/>\nDistrict\tPanchayat, Surat as a Work-charge Karkun temporarily for a<br \/>\n\tperiod of two months from 25th February, 1982 to 25th<br \/>\nApril, \t1982. The said arrangement continued for a pretty long<br \/>\ntime.\tHowever, since the year 1995, the petitioner&#8217;s service had\tbeen<br \/>\ndiscontinued. Feeling aggrieved, the petitioner has\tpreferred the<br \/>\npresent petition.\n<\/p>\n<p>Mr. Parikh  has submitted that the petitioner was not\tregularized in<br \/>\nservice only on the ground that he had not\tapproached the Court of<br \/>\nlaw and obtained order in his favour. \tHe has submitted that<br \/>\nsimilarly situated employees of the \tDistrict Panchayat were,<br \/>\npursuant to the order dated 15th \tNovember, 1988 of the<br \/>\nHon&#8217;ble Supreme Court, given the \tbenefit of regularization in<br \/>\nservice. The said benefit, however, \thas been denied to the<br \/>\npetitioner.\n<\/p>\n<p>It appears that a group of employees of the District \tPanchayat had<br \/>\nsought regularization in service. The claim\tmade by the said<br \/>\nemployees was rejected by this Court. The\tHon&#8217;ble Supreme Court by<br \/>\nits Order dated 15th November,\t1988 recorded that,<br \/>\n ..Though they were not appointed in\taccordance with the<br \/>\nprocedure prescribed by the\trecruitment rules, namely, through the<br \/>\nDistrict\tSelection Committee. We have considered all the facts \tand<br \/>\ncircumstances of the case. It seems to us just and\tproper that out of<br \/>\nthese Appellants who also the\tRespondents referred to hereinbefore,<br \/>\nthose who have\tnot appeared as yet before the Selection<br \/>\nCommittee\tshould be given a chance to appear before the<br \/>\nSelection\tCommittee and in case some of them have become age\tbarred,<br \/>\nthe Authority concerned will relax the age bar\tand permit them to<br \/>\nappear before the ensuing selection\tby the Selection Committee. Those<br \/>\nwho are qualified\tand selected by the Selection Committee will have<br \/>\ntheir\tservice regularized. So far as the question of continuity\tof<br \/>\nservice is concerned, it will be open to the authority\tto consider<br \/>\nand decide the same. The authority\tconcerned will of course leave out<br \/>\nthe artificial breaks\tin service for short periods.\n<\/p>\n<p>It is not in dispute that the<br \/>\npresent petitioner  was \tneither the petitioner nor the respondent<br \/>\nbefore the Hon&#8217;ble \tSupreme Court. It is also not in dispute that<br \/>\nduring his long\tservice from the year 1982 to 1995, the petitioner<br \/>\nnever\tapplied for selection through the District Panchayat<br \/>\nService\tSelection Committee. Mr. Parikh has relied upon<br \/>\nthe\tcommunication dated 17th<br \/>\nApril, 1989 sent by the Deputy\tExecutive Engineer, Panchayat [R&amp;B]<br \/>\nSub-Division, Valod\taddressed to the Executive Engineer, District<br \/>\nPanchayat. It\tappears that pursuant to certain information sought by<br \/>\nthe\tExecutive Engineer, District Panchayat, Surat, the<br \/>\nconcerned\tDeputy Executive Engineer had furnished<br \/>\ndetailed\tinformation of SSC passed work-charged Karkuns working\tunder<br \/>\nhim; one of them being the petitioner. However, it is\tfar from truth<br \/>\nthat the said information was sent in\tcompliance with the aforesaid<br \/>\ndirections issued by the\tHon&#8217;ble Supreme Court. There is nothing on<br \/>\nrecord to\tsuggest that the petitioner was called upon to appear<br \/>\nbefore\tthe District Panchayat Service Selection Committee nor did\tthe<br \/>\npetitioner ever bother to undergo the recruitment\tprocedure conducted<br \/>\nby the District Panchayat Service\tSelection Committee. Besides, the<br \/>\nrespondent has filed\tcounter affidavit stating that the petitioner<br \/>\nwas appointed\ttemporarily on work charge basis. On completion of<br \/>\nthe\tconcerned project, his service was not continued further.\n<\/p>\n<p>\t  \tBe that<br \/>\nas it may, it is not disputed that the petitioner is \tout \tof<br \/>\nPanchayat service since the year 1995. It is also not \tdisputed that<br \/>\nthe appointment of the petitioner was\ttemporary and was contrary to<br \/>\nthe statutory recruitment\trules. The petitioner had not been selected<br \/>\nby the District\tPanchayat Service Selection Committee. In absence of<br \/>\nproper \trecruitment, the petitioner&#8217;s claim for reinstatement<br \/>\nor\tregularization in service is not tenable. Further, by now,<br \/>\nthe\tpetitioner has attained the age of 45 years and the petitioner\tis<br \/>\nout of service of the District Panchayat for last twelve\tyears.<br \/>\nTherefore also, the petitioner cannot be ordered to be \treinstated in<br \/>\nservice.\n<\/p>\n<p>\t In above<br \/>\nview of the matter, the petition is dismissed. Rule is \tdischarged.<br \/>\nThe parties shall bear their own cost.\n<\/p>\n<p>3.0\tIn<br \/>\nthat view of the matter, this Court is of the opinion no<br \/>\nfurther order is required to be passed. Accordingly, petition stands<br \/>\ndisposed of.  Rule is<br \/>\ndischarged with no order as to costs.
