After following due procedure, a sample of Gutkha was<br \/>\npurchased from the opponents and ultimately, the said sample was sent<br \/>\nto the Public Analyst, Rajkot for examination. On examination, the<br \/>\nsaid sample was found that Gutkha misbranded under Section 2(ix) K of<br \/>\nthe Prevention of  Food Adulteration Act. Therefore, a complaint<br \/>\nunder the provisions of the Prevention of Food Adulteration Act was<br \/>\nfiled against the opponents before the Court below and a criminal<br \/>\ncase was registered against them. In the said case, the opponents<br \/>\npreferred application Exhibit &#8211; 10 praying for their discharge<br \/>\nfrom the alleged offence in question. The said application came to be<br \/>\nallowed by the Court below by way of passing the impugned order.<br \/>\nHence, this application.\n<\/p>\n<p>3.\t\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record.  The main contention raised by the applicant State is that<br \/>\nthe Court below erred in concluding that &#8216;Gutkha&#8217; does not fall<br \/>\nwithin the provisions of Prevention of Food Adulteration Act.<br \/>\nHowever, I find that there is nothing on record to show that &#8216;Gutkha&#8217;<br \/>\nhas been misbranded. No prescribed standard has been provided in the<br \/>\nAct with respect to &#8216;Gutkha&#8217; nor there is any provision to include<br \/>\n&#8216;Gutkha&#8217; as a food article.\n<\/p>\n<p>4.\t\tConsidering<br \/>\nthe facts of the case, and the provisions of the said Act, I am of<br \/>\nthe opinion that the Court below was completely justified in<br \/>\ndischarging the opponents from the alleged offence in question.  I am<br \/>\nin complete agreement with the reasonings given by and the findings<br \/>\narrived at by the Court below and hence, find no reasons to interfere<br \/>\nin this application.\n<\/p>\n<p>5.\t\tConsequently,<br \/>\nthe application is rejected. Rule is discharged.
