To quash the notification no.<br \/>\n                     3643(s) dated 24.06.1997 issued under the<br \/>\n                     signature of the Joint Secretary, Road<br \/>\n                     Construction Department, Govt. of Bihar,<br \/>\n                     Patna.\n<\/p>\n<p>                             b. For direction to the respondents<br \/>\n                     to consider the case of petitioners and<br \/>\n<span class=\"hidden_text\">                  2<\/span><\/p>\n<p>  confirm promotion    of the petitioners on<br \/>\n  the post of superintending Engineers from<br \/>\n  the dates they have been given officiating<br \/>\n  promotion with all benefits.\n<\/p>\n<p>          c. For direction to the respondents<br \/>\n  not to disturb the seniority of Bihar<br \/>\n  Engineering   Service   Class-I  (Executive<br \/>\n  Engineers, Superintending Engineers etc.)<br \/>\n  which had already been finally determined<br \/>\n  and published vide notification no. 6541(s)<br \/>\n  dated 11.12.1992.\n<\/p>\n<p>          d. For commanding the respondents<br \/>\n  not to intervene\/disturb the petitioners<br \/>\n  from the post of Superintending Engineers<br \/>\n  working at different places.\n<\/p>\n<p>          This Court is of the considered opinion<\/p>\n<p>that in view of the subsequent judgment of the<\/p>\n<p>Constitution Bench in the case of M. Nagaraj &amp;<\/p>\n<p>Ors vs The Union of India and Ors reported in<\/p>\n<p>2006(8)    SCC   212,     the    respondents     would    be<\/p>\n<p>required to redraw the seniority list as per the<\/p>\n<p>law   laid   down    by    the    Apex   Court    in     the<\/p>\n<p>aforementioned judgment.\n<\/p>\n<p>          Mr. Lalit Kishore on instructions from<\/p>\n<p>the respondent has submitted that such exercise<\/p>\n<p>of drawing of fresh seniority list in the light<\/p>\n<p>of the judgment of the Constitution Bench in the<\/p>\n<p>case of M.
