\t\tRule.\n<\/p>\n
Mr. M.R.Mengdey, learned Additional Public Prosecutor waives service
\nof notice of Rule on behalf of the respondent State.\n<\/p>\n
2.\t\tThis
\napplication under section 438 of the Code of Criminal Procedure, has
\nbeen preferred for grant of anticipatory bail, as the applicants
\napprehend their arrest in connection with FIR, being CR. No.I-1 of
\n2009, registered with Sihor  Police Station for  offences punishable
\nunder
\n  sections 406, 420, 467, 468 and 114, of the Indian Penal Code.\n<\/p>\n
3.\t\tThe
\nallegation against the applicants is that they are involved in the
\ncommission of the above-mentioned offences, whereby being members of
\nMahada Hira Udyog Sahakari Mandali Ltd.\n<\/p>\n
        , a loan of Rs. 2 lacs was taken from the complainant bank
\nwhich was not repaid nor any instalment given towards the same.\n<\/p>\n
4.\t\tMr.\n<\/p>\n
S.P.Kotia,  learned  counsel for the applicants has submitted that
\nthe applicants are farmers who had formed the said Mandali in order
\nto carry out diamond business collectively and as funds were
\nrequired, the loan was taken from the complainant bank. In fact,
\nmachinery for setting up diamond business was also purchased.
\nHowever, as heavy losses were suffered, the loans could not be repaid
\nand now in the year 2009, after a period of about 15 years, a
\ncriminal complaint has been lodged eventhough this dispute was the
\nsubject matter of arbitration proceedings in the year 1999. That the
\napplicants have not committed offences as alleged and as they are
\napprehending their arrest in connection with the above FIR, the
\napplication may be considered.\n<\/p>\n
5.\t\tOn
\nthe other hand, Mr. M.R.Mengdey, learned Additional Public Prosecutor
\nhas opposed the grant of anticipatory bail to the applicant.\n<\/p>\n
6.\t\tI
\nhave heard the learned counsel for the respective parties, perused
\nthe averments made in the application, contents of the FIR and other
\ndocuments on record.\n<\/p>\n
7.\t\tFrom
\na perusal of the contents of the FIR, it appears that the said loan
\nwas taken in the year 1999 by the applicants, who had formed the
\nabove-mentioned Mandali for the purpose of running diamond business.
\nIt further appears that as the applicants could not repay the said
\nloan or give the instalments, the loan has now escalated with
\ninterest and a sizeable amount appears to be pending against the
\napplicants. However, looking to the entirety of the facts and
\ncircumstances of the case, apart from non-payment of loan, the
\ncommission of offences as alleged against the applicants is not
\nclearly borne out from the record. Looking to the nature and gravity
\nof the offence and quantum of punishment that can be imposed upon
\nconviction, and considering the papers on record, interest of justice
\nwould be met if the prayer made in the application is granted.\n<\/p>\n
8.\t\tThe
\napplication is, accordingly, allowed, and the following order is
\npassed:\n<\/p>\n
\t\tIn
\nthe event of the arrest of the applicants  in CR.No.I-1 of 2009
\nlodged with Sihor Police Station,
\nfor offences under Sections
\n406, 420, 467, 468 and 114, of the Indian Penal Code,
\napplicants, namely (1) Vallabhbhai Parshottambhai Bhayani (2)
\nDilipbhai Thakarshibhai Bhayati (3) Manjibhai Thakarshibhai Bhayani
\n(4) Hamajibhai Jivabhai Parmar (5) Jahabhai Jethabhai Parmar (6)
\nManjibhai Khimjibhai Lathiya (7) Vallabhbhai Parshottambhai Sachapara
\n(8) Bhupatbhai Mohanbhai (9) Ghanshyambhai Ukabhai Mori (10)
\nPaljibhai Ugabhai and (11) Raghavbhai Mulabhai,  shall be released on
\nbail, on each of them  executing a bond of Rs.10,000\/-(Rupees Ten
\nThousand only) with one solvent surety of the like amount, to the
\nsatisfaction of the concerned police officer and on conditions that
\nthey shall;\n<\/p>\n
a)\tremain
\npresent before the Investigating Officer of the concerned Police
\nStation, on 7.5.2009 between 11:00 am to 5:00 pm. <\/p>\n
b)\tremain
\npresent before the trial Court regularly, as and when directed, on
\nthe dates fixed;\n<\/p>\n
c)\tmake
\nthemselves available for interrogation by the concerned police
\nofficer, whenever and wherever required.\n<\/p>\n
d)\tnot
\ndirectly or indirectly make any inducement, threat or promise to any
\nperson acquainted with the facts of the case so as to dissuade
\nhim\/her from disclosing such facts to the Court or to any Police
\nOfficer;\n<\/p>\n
e)\tnot
\nobstruct or hamper the police investigation and not play mischief
\nwith the evidence collected or yet to be collected by the police;\n<\/p>\n
f)\tat
\nthe time of execution of bond, furnish their residential address to
\nthe Investigating Officer and the Courts concerned, and shall not
\nchange their residence as far as possible till the final disposal of
\nthe case or till further orders. In case the applicants wish to
\nchange their residential address, prior permission to do so shall be
\nobtained from the Court and with intimation to the Investigating
\nOfficer concerned;\n<\/p>\n
g)\tnot
\nleave India without the permission of the Court and, if having
\nPassports, shall deposit the same before the trial Court within a
\nweek;\n<\/p>\n
9.\t\tIt
\nwould be open to the Investigating Officer to      file an
\napplication for remand if he considers it proper and just; and the
\nlearned Magistrate would decide it on merits.\n<\/p>\n
10.
\n\t\tThis order will hold good if the applicants are arrested at any
\ntime within 90 days from today. The order for release on bail will
\nremain operative only for a period of TEN days from the date of their
\narrest. Thereafter it will be open to the applicants to make a fresh
\napplication for being enlarged on bail in usual course which when it
\ncomes before the competent Court, will be disposed of in accordance
\nwith law, having regard to all the attending circumstances and the
\nmaterials available at the relevant time, uninfluenced by the fact
\nthat anticipatory bail was granted.\n<\/p>\n
11.\t\tIt
\nis made clear that no observation made by this Court  be construed as
\nhaving any bearing on the merits of the case, at the time of trial.
\nThe trial Court will proceed in accordance with law, unaffected and
\nuninfluenced by any observation contained in this order.\n<\/p>\n
12.
\n\t\tRule is made absolute to the above extent. Direct service is
\npermitted.\n<\/p>\n
