Justice V.RAMKUMAR\n\n Dated :03\/11\/2010\n\n O R D E R\n                         V.RAMKUMAR, J.\n             ----------------------------------------------\n              Bail Application No.6903 of 2010\n            ------------------------------------------------\n         Dated this the 3rd day of November, 2010\n\n                               ORDER\n<\/pre>\n<p>      The petitioner, who is the sole accused in Crime No.1097 of<\/p>\n<p>2010 of Pathanapuram Police Station for offences punishable under<\/p>\n<p>Sections 353 &amp; 308 I.P.C. and Sections 20 &amp; 21 of the Act 18 of<\/p>\n<p>2001, seeks anticipatory bail.\n<\/p>\n<p>      2.   The learned Public Prosecutor opposed the application.<\/p>\n<p>      3.    Anticipatory bail cannot be granted in a case of this<\/p>\n<p>nature. But at the same time, I am inclined to permit the petitioner<\/p>\n<p>to surrender before the Investigating Officer for the purpose of<\/p>\n<p>interrogation and then to have his application for bail considered<\/p>\n<p>by the Magistrate having jurisdiction. Accordingly, the petitioner<\/p>\n<p>shall surrender before the investigating officer on 15\/11\/2010 or<\/p>\n<p>on 16\/11\/2010 for the purpose of interrogation and recovery of<\/p>\n<p>incriminating material, if any. The petitioner shall thereafter be<\/p>\n<p>produced before the Magistrate who on being satisfied that the<\/p>\n<p>petitioner has been interrogated by the police shall consider and<\/p>\n<p>dispose of his application for regular bail preferably on the same<\/p>\n<p>date on which it is filed.\n<\/p>\n<p>      This petition is disposed of as above.\n<\/p>\n<\/p>\n<p>                                           V.RAMKUMAR, JUDGE<\/p>\n<p>skj<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Madhukumar G. vs The S.I.
