Justice ANTONY DOMINIC\n\n Dated :27\/03\/2008\n\n O R D E R\n                          ANTONY DOMINIC, J.\n\n              ------------------------------------\n\n                        W.P.(C) 34086 of 2007\n\n             -------------------------------------\n\n                        Dated: MARCH 27, 2008\n\n                              JUDGMENT\n<\/pre>\n<p>      In this writ petition the challenge is against the securitisation<\/p>\n<p>proceedings.\n<\/p>\n<p>      2.  Interim orders were passed on 24.1.2008 and 29.1.2008<\/p>\n<p>and the petitioner was given freedom to buy the property by<\/p>\n<p>payment of the reserve price. It is now submitted by the standing<\/p>\n<p>counsel for the bank that the petitioner did not avail of the<\/p>\n<p>opportunities thus granted by the aforesaid orders. According to<\/p>\n<p>the standing counsel, on the other hand, petitioner submitted a<\/p>\n<p>proposal for settlement of the liability.<\/p>\n<p>      3.  Be that as it may, admittedly the firm, of which the<\/p>\n<p>petitioner was also a partner, is a defaulter and therefore the bank<\/p>\n<p>is entitled to initiate proceedings under the Securitization and<\/p>\n<p>Reconstruction of Financial Assets and Enforcement of Security<\/p>\n<p>Interest Act, 2002 and it is for the bank to decide which property is<\/p>\n<p>WP(C) 34086\/07<br \/>\n                             Page numbers<\/p>\n<p>to be proceeded against.
