SIRI JAGAN, J.\n                  --------------------------------\n                   W.P.(C) Nos. 25388\/09 &amp;\n                           25989 OF 2009\n                  -------------------------------\n             Dated this the 2nd day of JUNE, 2010\n\n\n                         J U D G M E N T\n<\/pre>\n<p>      These writ petitions relate to the entitlement of the<\/p>\n<p>petitioners for appearing for the fourth year examination of the<\/p>\n<p>BDS course.    The issue involved in these writ petitions has been<\/p>\n<p>extensively considered by a learned Single Judge of this Court<\/p>\n<p>and interim orders have been passed which are identical in both<\/p>\n<p>case. The order is quoted below:\n<\/p>\n<blockquote><p>          Heard Sri.A.Mohammed Mustaque, the learned counsel<br \/>\n          appearing for the petitioners and Sri.M.Sasindran, the<br \/>\n          learned standing counsel appearing for respondents 1<br \/>\n          to 3.   There was no representation for the fourth<br \/>\n          respondent.<\/p>\n<blockquote><p>                2. The petitioners are students undergoing the<br \/>\n          BDS   Degree    course   in Century     Dental  College,<br \/>\n          Kasaragod. They appeared for the second year BDS<br \/>\n          Examination conducted by the Kannur University in<br \/>\n          November, 2008. The third year classes commenced in<br \/>\n          January, 2009.    While the petitioners were attending<br \/>\n          the third year classes, the result of the second year<br \/>\n          BDS Examination held in November, 2008 was<br \/>\n          published on 20.7.2009. The petitioners failed in more<br \/>\n          than one subject. As per the Regulations for the BDS<br \/>\n          Course, only a candidate who has passed all the second<br \/>\n          year BDS subjects can be promoted to the third year of<br \/>\n          the course.\n<\/p><\/blockquote>\n<blockquote><p>                3. Apprehending that they will not be permitted<br \/>\n          to continue their studies the petitioners moved the Vice<\/p>\n<p><span class=\"hidden_text\">W.P.(c)No.25388\/09 &amp; Con.case          2<\/span><\/p>\n<p>            Chancellor of Kannur University by submitting<br \/>\n            Ext.P11    representation   seeking    permission   to<br \/>\n            continue to attend the third year classes. This writ<br \/>\n            petition was thereafter filed on 7.9.2009 seeking a<br \/>\n            direction to the respondents to permit the petitioners<br \/>\n            to continue their studies in the third year of the BDS<br \/>\n            course    and   to  appear    for   the  examination.<br \/>\n            Meanwhile, a supplementary examination was also<br \/>\n            conducted in August, 2009.            The petitioners<br \/>\n            registered and appeared for the said examination.<br \/>\n            The results were published on 7.12.2009.           The<br \/>\n            petitioners passed the papers in which they had<br \/>\n            failed in their maiden attempt.        The petitioners<br \/>\n            submit that in such circumstances as they have now<br \/>\n            passed the second year BDS Examination and as<br \/>\n            they have been attending classes regularly since<br \/>\n            January, 2009, they may be permitted to appear for<br \/>\n            the third year BDS Examination commencing on<br \/>\n            17.12.2009. The petitioners contend that as they<br \/>\n            were pursuing their studies in the third year, the<br \/>\n            delay on the part of the University in publishing the<br \/>\n            result of the second year examination conducted in<br \/>\n            November, 2008 cannot be a reason to deny them<br \/>\n            appearance in the third year examination especially<br \/>\n            when they have passed the second year examination<br \/>\n            in full though belatedly in the supplementary<br \/>\n            examination.\n<\/p><\/blockquote>\n<blockquote><p>                   4. Sri.M.Sasindran, the      learned standing<br \/>\n            counsel appearing for the Kannur University submits<br \/>\n            that the Regulations stipulate that a candidate<br \/>\n            should have passed the second year examination in<br \/>\n            full before he is promoted to the course of study for<br \/>\n            the third year and that carry over is not permitted.<br \/>\n            The petitioners who failed in the second year<br \/>\n            examination could not have continued their studies<br \/>\n            in the third year of the course, it is submitted. The<br \/>\n            learned counsel submits that the mere fact that the<br \/>\n            petitioners have passed the second year BDS<br \/>\n            Examination in the second attempt is not a ground to<br \/>\n            permit them to attend the third year classes or to<br \/>\n            appear in the third year examination.\n<\/p><\/blockquote>\n<blockquote><p>                   5. I have considered the submissions made at<br \/>\n            the Bar by the learned counsel appearing on either<br \/>\n            side. Regulation No.5 of the Regulations governing<br \/>\n            the BDS course reads as follows:\n<\/p><\/blockquote>\n<blockquote><p>                        &#8220;The candidate should pass in all the<br \/>\n                  IInd BDS subjects before he is promoted to<br \/>\n                  the course of study for IIIrd BDS .&#8221;\n<\/p><\/blockquote>\n<\/blockquote>\n<p><span class=\"hidden_text\">W.P.(c)No.25388\/09 &amp; Con.case          3<\/span><\/p>\n<blockquote><p>            If Regulation No.5 is strictly implemented, it would<br \/>\n            mean that all the students who appeared for the<br \/>\n            second year BDS examination held in November,<br \/>\n            2008, would have sit out till 20.7.2009 when the<br \/>\n            result of the said examination was published. Such a<br \/>\n            situation is not contemplated by the Regulations. The<br \/>\n            University took nearly eight months to publish the<br \/>\n            results.    If the regulations are to be strictly<br \/>\n            implemented, the University should also be diligent<br \/>\n            in conducting the examinations and in publishing the<br \/>\n            results.    It cannot therefore be said that the<br \/>\n            petitioners should have waited till 20.7.2009 to be<br \/>\n            told whether they can attend the third year classes.<br \/>\n            The learned counsel appearing for the University was<br \/>\n            not able to point out any provision in the University<br \/>\n            Act, Statutes,     Ordinances or Regulations which<br \/>\n            stipulate that higher classes can commence only<br \/>\n            after the results of the lower examination are<br \/>\n            published.    In such circumstances,     the period of<br \/>\n            study undergone by the petitioners in the third year<br \/>\n            of the course after appearing in the second year<br \/>\n            examination till 20.7.2009 when the result of the<br \/>\n            second year examination was published cannot be<br \/>\n            wiped out. Further, the petitioners state that they<br \/>\n            continued to attend the classes thereafter also.\n<\/p><\/blockquote>\n<blockquote><p>            They    also    appeared    for   and    passed    the<br \/>\n            supplementary examination held in August, 2009 the<br \/>\n            result of which was     published on 7.12.2009.      In<br \/>\n            other words, the petitioners have passed the second<br \/>\n            year BDS Examination within five months from the<br \/>\n            date on which the result of the examination held in<br \/>\n            November,      2008   was    published.       In  such<br \/>\n            circumstances, in the interests of justice, I am of the<br \/>\n            opinion that the petitioners should be permitted to<br \/>\n            appear    for  the   third  year   BDS    Examination<br \/>\n            commencing on 17.12.2009 if they have the required<br \/>\n            attendance in the third year classes.\n<\/p><\/blockquote>\n<blockquote><p>                   I accordingly direct the respondents to permit<br \/>\n            the petitioners to appear for the third year BDS<br \/>\n            Examination commencing on 17.12.2009 if they have<br \/>\n            the required attendance. If the petitioners have the<br \/>\n            required attendance, the respondents shall permit<br \/>\n            them to appear for the examination and also make<br \/>\n            necessary arrangements by issuing hall tickets and<br \/>\n            by providing the requisite number of question paper<br \/>\n            booklets and answer books.\n<\/p><\/blockquote>\n<blockquote><p>                   Registry to hand over a copy of this order to<br \/>\n            both sides on usual terms today itself&#8221;.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">W.P.(c)No.25388\/09 &amp; Con.case      4<\/span><\/p>\n<p>The writ petitions were finally heard by me.        I am in full<\/p>\n<p>agreement with the conclusions reached by the learned Single<\/p>\n<p>Judge in the interim orders, which actually dispose of the writ<\/p>\n<p>petitions themselves.        Therefore, I dispose of these writ<\/p>\n<p>petitions   in   terms of     the   above  said  interim order.<\/p>\n<p>Consequently, there would be a direction to the University to<\/p>\n<p>publish the results of the examination, which the petitioners<\/p>\n<p>have written, as if the same has been written validly. Needless<\/p>\n<p>to say, the mark lists etc., should also be issued to the<\/p>\n<p>petitioners.\n<\/p>\n<\/p>\n<p>                                      S.
