SAJILA KHATOO\n                                    ...OPPOSITE PARTIES\n                                        -----------\n<\/pre>\n<p>2.   27.09.2010               Heard.\n<\/p>\n<p>                              Petitioner is the husband. He assails the order dated<\/p>\n<p>                  28.10.2009, whereby on a consideration of the case made out by<\/p>\n<p>                  the applicant-wife and the rejoinder filed by the husband-<\/p>\n<p>                  petitioner, ad-interim maintenance in the sum of Rs.1500\/- has<\/p>\n<p>                  been fixed payable to the applicant-wife. The matter was<\/p>\n<p>                  thereafter fixed for evidence.\n<\/p>\n<p>                              Counsel for the petitioner states that the petitioner in<\/p>\n<p>                  his rejoinder outrightly denied the alleged marriage with the<\/p>\n<p>                  applicant(o.p.no.2) .\n<\/p>\n<p>                              This Court perused the pleadings made in paragraphs<\/p>\n<p>                  6 and 9 of the application. Learned trial court has taken a view<\/p>\n<p>                  that a lady cannot dare to approach the court declaring herself as<\/p>\n<p>                  wife of a person and thereby claiming maintenance.<\/p>\n<p>                              This Court declines to interfere with the order<\/p>\n<p>                  impugned, whereby only ad-interim maintenance has been fixed<\/p>\n<p>                  and directed to be paid to o.p.no.2. All issues are yet to be raised<\/p>\n<p>                  and considered by learned Family Court where the evidence<\/p>\n<p>                  shall be laid by the parties in support of their respective cases.<\/p>\n<p>                              Let the petitioner raise all these facts\/grievances<br \/>\n<span class=\"hidden_text\">                            2<\/span><\/p>\n<p>     before the learned Principal Judge, Family Court, Kaimur and<\/p>\n<p>     adduced supporting evidence        which shall be considered by<\/p>\n<p>     learned court below in accordance with law while disposing of<\/p>\n<p>     the application finally.\n<\/p>\n<p>                 With the aforesaid observations, the matter stands<\/p>\n<p>     disposed of.\n<\/p>\n<\/p>\n<p>                                ( Kishore K.
