JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\nDate\n: 08\/10\/2010 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE D.H.WAGHELA)<\/p>\n<p>1.\tRULE.\n<\/p>\n<p>Leaned Addl.P.P., Mr. K. J. Panchal waives service for the<br \/>\nrespondent.\n<\/p>\n<p>2.\tThe<br \/>\npetitioner has applied for regular bail by suspending  the sentence<br \/>\nduring pendency of his appeal before this Court. The petitioner is<br \/>\none of the convicted persons who have been convicted of serious<br \/>\noffences and sentenced to imprisonment up to ten years by the<br \/>\njudgement and order dated 12.01.2010 of learned Special Judge under<br \/>\nthe POTA, Ahmedabad, in POTA Case No. 12 of 2003.\n<\/p>\n<p>3.\tAfter<br \/>\npointing out the fact that the applicant is also convicted in another<br \/>\ncriminal case and sentenced to imprisonment for life, learned<br \/>\nAddl.P.P. Mr. Panchal fairly conceded that all the persons convicted<br \/>\nin the aforesaid POTA Case No. 12 of 2003 who had preferred<br \/>\napplications for suspending the sentence and releasing on bail, have<br \/>\nbeen released on bail by judgement dated 13.07.2010 of Division Bench<br \/>\nof this Court in Criminal Misc. Application No. 3307 of 2010 and<br \/>\nallied matters. There is no dispute about the fact that the<br \/>\npetitioner has already undergone more than seven years of<br \/>\nimprisonment and both the appeals arising from his conviction for<br \/>\ndifferent offences are unlikely to be heard in the near future. It<br \/>\nwas submitted by learned counsel Mr. Barot that the other appeal<br \/>\nagainst conviction of the applicant is presently listed for final<br \/>\nhearing before another bench; and if that appeal is heard or an<br \/>\napplication for bail is  made and granted in that pending appeal, the<br \/>\npetitioner would require an order of suspension of sentence in the<br \/>\npresent proceeding so that any order in his  favour in the other<br \/>\nappeal could be meaningful and effective.\n<\/p>\n<p>4.\tUnder<br \/>\nthe above facts and circumstances, adopting the grounds and reasons<br \/>\ndiscussed in judgement dated 13.07.2010 in Criminal Misc. Application<br \/>\nNo. 3307 of 2010, the present application is allowed. The  applicant<br \/>\nis ordered to be released on bail on executing personal bond of Rs.<br \/>\n50,000\/- with solvent surety of the like amount to the satisfaction<br \/>\nof the lower court and subject to the conditions that he shall-\n<\/p>\n<p>\t(a)\tnot<br \/>\nleave Gujarat State without prior permission of\tthis Court;\n<\/p>\n<p>\t(b)\tnot<br \/>\ntake undue advantage of liberty or abuse\tliberty;\n<\/p>\n<p>\t(c)\tnot<br \/>\nindulge in any illegal activities;\n<\/p>\n<p>(d) \tfurnish<br \/>\n\tthe present and permanent address of\tresidence to the Court at the<br \/>\n\ttime of execution of\tthe bond and shall not change the residence<br \/>\n\twithout \tprior permission of this Court;\n<\/p>\n<p>(e)\tmark<br \/>\n\tpresence before the Police Station concerned\tonce in a month on any<br \/>\n\tday between 1st<br \/>\n\tand 5th<br \/>\n\tof\tevery month at any time between 11.00 a.m and\t5.00 p.m; and;\n<\/p>\n<p>(f)\tsurrender<br \/>\npassport, if any, within a week to the lower court and if not holding<br \/>\npassport, file undertaking before the trial court to the effect that<br \/>\nthey will not leave India without prior permission of the Court.\n<\/p>\n<p>5.\tIf<br \/>\nbreach of any of the above conditions is committed, this order for<br \/>\nbail shall stand cancelled automatically.\n<\/p>\n<p>6.\tRule<br \/>\nis made absolute accordingly with the clarification that above order<br \/>\nshall not come into effect till the petitioner is undergoing<br \/>\nimprisonment pursuant to any other case and till he is exonerated or<br \/>\ngranted bail in such other case.
