that the defendant No.2 is trespasser.\n<\/p>\n

\n iseneidii legaiu toiithe defendant No. 1 for disconnection of<\/p>\n

._plaintiA\ufb01Z’ gaeeeeaee that the p1a:inti\ufb01’ had aineady \ufb01led a suit<\/p>\n
it  defendant’  in O S No.168\/2006 for permanent injunction.<\/p>\n
‘ i t1efendant..NoE1\/ KPFCL remained absent before the trial Court. The<\/p>\n
 entered appearance and filed written statement admitting<\/p>\n
  was running a tea shop in T P No.67, but he denie\u00e9 all<\/p>\n
‘together  avfennents. It is contended that the shop premises belongs to<\/p>\n
Sit Shitvayogi Mandir Trust one he is a tenant under the said Trust and<\/p>\n
he has been paying rents Iegulariy. It was aiso contended that the Trust<\/p>\n

\nelectricity charges to the authority concerned and prayed  of<\/p>\n
the suit with costs.\n<\/p>\n
5. 011 the basis of the p1eadi11gs, . the
\nissues. In support of the case of the vhhegote
\nRW-1 besides examining one   as
\nP.W-2 and got marked Exs.?–}. to    defendant No.2
\ngot: him examined as     hearing arguinents
\nand perusing evider2eel’l\u00bbm:iiteriol answered issue No.1 in the
\nnegative   ‘terrrpiove that the defendant No.2
\nunlawfully obtziizied  shop from defendant No. 1. The
\ntrial Court \ufb01lrtherlll\u00e9musweredll’Viee1;;%”_.’;\\}o.2 in the negative holding that the
\n   and dismissed the suit. Feeling<\/p>\n
