JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 20\/04\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tThis<br \/>\npetition, under Article 226 of the Constitution of India, has been<br \/>\nfiled with the following prayers:-\n<\/p>\n<p>&#8220;(A)\tYour<br \/>\nLordships will be pleased to admit and allow this petition.\n<\/p>\n<p>[B]\tYour<br \/>\nLordships will be pleased to issue a writ of mandamus or any other<br \/>\nappropriate writ, order and\/or direction directing the Respondents to<br \/>\ntransfer the Petitioner from Vavdi, Taluka: Sutrapada, District<br \/>\nJunagadh to Dhoraji, Taluka: Dhoraji, District Rajkot as<br \/>\nexpeditiously as possible, in the interest of justice;\n<\/p>\n<p>[C]\tPending<br \/>\nadmission, hearing and final disposal of the present petition Your<br \/>\nLordships will be pleased to pass order directing the Respondents to<br \/>\nconsider the request of the petitioner;\n<\/p>\n<p>[D]\tAn<br \/>\nex-parte ad interim relief in terms of prayer(C) above may kindly be<br \/>\ngranted;\n<\/p>\n<p>[E]\tYour<br \/>\nLordships will be pleased to grant such other and further relief\/s,<br \/>\nas are deemed just, fit, proper &amp; necessary in the interest of<br \/>\njustice.&#8221;\n<\/p>\n<p>2.\tAt<br \/>\nthe very outset, Mr. Dipak H. Sindhi,  learned  advocate  for the<br \/>\npetitioner submits that the interest of justice would be met, if the<br \/>\npetitioner is permitted to make a representation to respondent No.2<br \/>\nfor the redressal of his grievances, and the said respondent may be<br \/>\ndirected to consider and decide the same, expeditiously.\n<\/p>\n<p>3.\tUpon<br \/>\nthe above statement being made by the learned advocate for the<br \/>\npetitioner, the following order is passed :-\n<\/p>\n<p>(a)\tThe<br \/>\npetitioner is permitted to make a representation to respondent No.2,<br \/>\nwithin a period of 15 days from today.\n<\/p>\n<p>(b)\tIf<br \/>\nthe said representation is made within the stipulated period of time,<br \/>\nrespondent No.2 shall consider and decide the same, in<br \/>\naccordance with law, within a period of one month from the<br \/>\ndate of receipt thereof.\n<\/p>\n<p>\tIt<br \/>\nis clarified that while passing this order, the Court has not entered<br \/>\ninto the merits of the case.\n<\/p>\n<p>4.\tThe<br \/>\npetition is disposed of, in the above terms.\n<\/p>\n<p>\tDirect<br \/>\nService of this order is permitted.\n<\/p>\n<p>(Smt.\n<\/p>\n<p>Abhilasha Kumari, J.)<\/p>\n<p>Safir*\t\t\t<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Hirapara vs State on 20 April, 2011 Author: Abhilasha Kumari,&amp;Nbsp;
