Justice K.P.BALACHANDRAN\n\n Dated :07\/06\/2007\n\n O R D E R\n                    J.B.KOSHY &amp; K.P.BALACHANDRAN, JJ.\n\n                 -------------------------------------\n\n                          M.F.A.No.1322 OF 2000\n\n                 -------------------------------------\n\n                          Dated 7th June,  2007\n\n\n\n                                  JUDGMENT\n<\/pre>\n<p>Koshy,J<br \/>\n        .\n<\/p>\n<p>              Appellant\/petitioner   met   with   a   motor   accident   by<\/p>\n<p>which he sustained serious injuries while he was travelling as<\/p>\n<p>a   pillion   rider   in   a   motor   cycle   driven   by   the   fourth<\/p>\n<p>respondent.  The lorry driven  by the  first  respondent owned by<\/p>\n<p>the second  respondent and insured by the third respondent hit<\/p>\n<p>the   vehicle   and   the   accident   occurred.            He   claimed   a<\/p>\n<p>compensation   of   Rs.1,50,000\/=.     The   Tribunal   found   that   the<\/p>\n<p>accident   occurred   due   to   the   negligence   of   the   first<\/p>\n<p>respondent.     Insurance   company   (R3)   was   directed   to   deposit<\/p>\n<p>the   amount.        However,   only   Rs.24,950\/=   was   awarded   as<\/p>\n<p>compensation.     Only   quantum   of   compensation   is   disputed   in<\/p>\n<p>this   appeal.     Hence,   we   are   considering   that   aspect   alone   in<\/p>\n<p>this appeal.\n<\/p>\n<p>              2.   Appellant   was   aged   30   at   the   time   of   the<\/p>\n<p>accident.   According   to   him,   he   was   a   coolie.     The   accident<\/p>\n<p>occurred on 29.12.1991.  The Tribunal fixed only Rs.1,000\/= as<\/p>\n<p>monthly   wages.     He   was   an   able   bodied   man   maintaining   a<\/p>\n<p>family.  When second schedule was framed in 1994, the notional<\/p>\n<p>income   of   a   non-earning   person   was   fixed   as   Rs.1,250\/=<\/p>\n<p><span class=\"hidden_text\">MFA.1322\/2000                        2<\/span><\/p>\n<p>(Rs.15,000\/=   per   year).     It   is   true   that   the   accident<\/p>\n<p>occurred   on   29.12.1991.     Appellant   is   not   a   non-earning<\/p>\n<p>person,   but,   is   an   earning   person.             In   the   above<\/p>\n<p>circumstances,   we   are   of   the   opinion   that   at   least<\/p>\n<p>Rs.1,250\/= should   be fixed as monthly income.   He was aged<\/p>\n<p>30 at the time of the accident.   It was repeatedly held by<\/p>\n<p>the   Apex   Court   that   multiplier   has   to   be   fixed   taking<\/p>\n<p>guidance from the second schedule.  A three member bench of<\/p>\n<p>the   Supreme   Court   in        Smt.Supe   Dei   and   others          v.\n<\/p>\n<p>M\/s.National   Insurance   Company   Ltd.   and   another  (JT   2002<\/p>\n<p>(Suppl.1)   SC   451)   held   that   the   second   schedule   of   the<\/p>\n<p>Motor   Vehicles   Act   is   framed   for   the   purpose   of   awarding<\/p>\n<p>compensation   under   Section   163A,   but,   it   serves   as   a<\/p>\n<p>guideline   for   determination   of   compensation   under   Section<\/p>\n<p>166   of   the   Motor   Vehicles   Act.     Since   the   victim   of   the<\/p>\n<p>accident   in   that   case   was   aged   32,   considering   the   second<\/p>\n<p>schedule,   Hon&#8217;ble   Supreme   Court   accepted   17   as   the<\/p>\n<p>multiplier.     In  United   India   Insurance   Co   Ltd.  v.  Patricia<\/p>\n<p>Jean Mahajan and others  (JT 2002 (5) SC 74), the Apex Court<\/p>\n<p>held   that,   except   in   very   rare   cases,   multiplier   system<\/p>\n<p>should not be deviated from.  The other methods, which were<\/p>\n<p>in   vogue   prior   to   the   introduction   of   the   multiplier<\/p>\n<p>system,   were   held   to   be   no   more   good   system.     It   was<\/p>\n<p><span class=\"hidden_text\">MFA.1322\/2000                        3<\/span><\/p>\n<p>further   held   that   normally   the   multiplier,   as   indicated   in<\/p>\n<p>the   second   schedule,   should   be   applied.     Though   the   second<\/p>\n<p>schedule   is   found   to   be   a   safe   guide   for   the   purpose   of<\/p>\n<p>calculation   of   the   amount   of   compensation,   in   special<\/p>\n<p>circumstances, it can be varied.  In that case, it was also<\/p>\n<p>held   that   if   the   multiplicand   is   very   high,   a   lesser<\/p>\n<p>multiplier can be taken.  <a href=\"\/doc\/1407348\/\">In  Abati Bezbaruah  v.  Dy.Director<\/p>\n<p>General,   Geological   Survey   of   India   and<\/a>   another  ((2003)   3<\/p>\n<p>SCC   148),   it   was   held   that   structured   formula   mentioned   in<\/p>\n<p>the   second   schedule   gives   guidelines   for   determination   of<\/p>\n<p>the   amount   of   compensation   in   terms   of   Section   166   of   the<\/p>\n<p>Motor Vehicles Act.   Deviation from the structured   formula<\/p>\n<p>can be resorted to only in exceptional cases and ordinarily<\/p>\n<p>the above multiplier system should be followed.   If that be<\/p>\n<p>so, 17 is the apt multiplier.\n<\/p>\n<p>            3. Now, we will come to the disabilities occurred<\/p>\n<p>to the appellant due to the accident.  He was treated as an<\/p>\n<p>inpatient   for   13   days   in   the   Medical   College   Hospital,<\/p>\n<p>Calicut.     Subsequently   also   he   has   undergone   treatment.\n<\/p>\n<p>Disability   certificate   was   issued   by   Dr.C.C.Suresh   M.S.,<\/p>\n<p>Department   of   Surgery,   Medical   College   Hospital,   Calicut<\/p>\n<p>which was marked as Ext.A5.  The above certificate reads as<\/p>\n<p><span class=\"hidden_text\">MFA.1322\/2000                                4<\/span><\/p>\n<p>follows:\n<\/p>\n<blockquote><p>                            &#8220;Certified   that   I   have   today<\/p>\n<p>            examined   Sri.Moosa   30   years   who   was<\/p>\n<p>            under   my   treatment   from   29.12.91   as   IP<\/p>\n<p>            59313   following   an   alleged   traffic<\/p>\n<p>            accident   which   occurred   on     29.12.91<\/p>\n<p>            following   which   he   was   admitted   at   MCH<\/p>\n<p>            Calicut         after         reference                from         KPM<\/p>\n<p>            Hospital,   Malappuram   and   he   was   having<\/p>\n<p>            Head   Injury   with   CT   proved   communited<\/p>\n<p>            depressed   fracture   of   Right   frontal<\/p>\n<p>            base   and   was   discharged   on   6.1.92   with<\/p>\n<p>            an   advice   of   long   term   Anticonvulsant<\/p>\n<p>            drugs.     As   he   is   now   having   recurrent<\/p>\n<p>            Headache   and   occasional   epileptic   fits<\/p>\n<p>            which  can  be  due  to  the  post  traumatic<\/p>\n<p>            sequelae.     So,   I   consider   that   the<\/p>\n<p>            above   patient   is   having   a   permanent<\/p>\n<p>            disability of about fifteen percent.&#8221;<\/p>\n<\/blockquote>\n<p>According   to   the   doctor,   appellant   has   15%   disability.\n<\/p>\n<p>Appellant   also   has   a   case   that   due   to   the   accident   he<\/p>\n<p>developed         depressive         mood         and         he          was         treated         by<\/p>\n<p>Dr.D.Sreekumar,             Associate             Professor                of          Psychiatry,<\/p>\n<p>Government   Health   Centre,   Calicut.     Ext.A8   shows   that   he<\/p>\n<p>has  developed     organic  mood  disorder.    On  the  basis  of  the<\/p>\n<p>certificates   produced   (Exts.A5   and   A8),   compensation   was<\/p>\n<p>not   calculated   on   a   scientific   basis,   but,   only   Rs.7,500\/=<\/p>\n<p>was   granted   as   compensation   for   disability   and   loss   of<\/p>\n<p>earning   power.     Ext.A5   certificate   shows   that   he   is   having<\/p>\n<p>epilepsy  due  to  the  accident.     There  was  head  injury.   The<\/p>\n<p><span class=\"hidden_text\">MFA.1322\/2000                        5<\/span><\/p>\n<p>doctor   certified   15%   disability.              Considering   Ext.A5<\/p>\n<p>certificate   and   the   nature   of   his   job,   we   take   10%<\/p>\n<p>disability.  If  that be  so, compensation  payable will be<\/p>\n<p>Rs.15,000 x 17 x  10 = 25,500\/=.  The  Tribunal  has awarded<\/p>\n<p><span class=\"hidden_text\">                    100<\/span><\/p>\n<p>only   Rs.7,500\/=   for   disability   and   loss   of   earning<\/p>\n<p>capacity.   Hence, the claimant is entitled to an additional<\/p>\n<p>amount of Rs.18,000\/= on this count.   For disfigurement and<\/p>\n<p>loss of teeth, the Tribunal has awarded Rs.2,000\/=.  We are<\/p>\n<p>not interfering with the same.  We have taken Rs.1,250\/= as<\/p>\n<p>monthly   income.     For   loss   of   earnings   for     the   period   he<\/p>\n<p>was actually bed ridden, the Tribunal has given Rs.3,000\/=.\n<\/p>\n<p>Since we have taken Rs.1,250\/= as the monthly income, he is<\/p>\n<p>entitled   to   an   additional   amount   of   Rs.750\/=   under   that<\/p>\n<p>head.     It   is   the     case   of   the   appellant   that   the   entire<\/p>\n<p>medical   bills   were   not   produced.     The   medical   certificates<\/p>\n<p>show   that   he   needs   continuous   treatment.     He   has   also<\/p>\n<p>produced  various medical bills to show that even now he is<\/p>\n<p>continuing   treatment.     Medical   bills   for   only   Rs.656\/=   was<\/p>\n<p>produced before the Tribunal.   But, the Tribunal found that<\/p>\n<p>during   the   period   of   treatment     all   the   medical   bills<\/p>\n<p>cannot   be   produced   and   the   amount   awarded   for   medical<\/p>\n<p>expenses   was   Rs.1,500\/=.     Considering   the   future   treatment<\/p>\n<p>and   nature   of   head   injury,   we   are   granting   an   additional<\/p>\n<p><span class=\"hidden_text\">MFA.1322\/2000                       6<\/span><\/p>\n<p>amount   of   Rs.5,000\/=   for   medical   expenses   and   future<\/p>\n<p>medical   expenses.         Even   though   it   is   contended   that<\/p>\n<p>compensation   awarded   under   other   heads   are   also   very<\/p>\n<p>meagre,   we   are   not   giving   any   enhancement   under   other<\/p>\n<p>heads.        Therefore,   the   appellant        is   entitled   to   an<\/p>\n<p>additional   amount   of   Rs.23,750\/=.     The   above   amount   of<\/p>\n<p>Rs.23,750\/=   should   be   deposited   by   the   third   respondent<\/p>\n<p>insurance company, over and above the decreed amount by the<\/p>\n<p>Tribunal,   with   8%   interest   from   the   date   of   accident   till<\/p>\n<p>its   deposit.
