In response thereto,<br \/>\n\tCriminal Misc. Application (for condonation of delay) was filed on<br \/>\n\t3.1.2011. On removal of office objections, the above numbered<br \/>\n\tCriminal Appeal was transferred to criminal department on 18.1.2011,<br \/>\n\twhereas the above numbered Criminal Appeal was transferred<br \/>\n\tseparately on 21.1.2011 through oversight.  Since the above numbered<br \/>\n\tCriminal Appeal was transferred to the criminal department on<br \/>\n\t18.1.2011, the same was listed for admission hearing on 8.2.2011<br \/>\n\tbefore this Court without Criminal Misc. Application (for<br \/>\n\tcondonation of delay).  As the Criminal Misc. Application (for<br \/>\n\tcondonation of delay) was not attached with the above numbered<br \/>\n\tCriminal Appeal, the Appeal was &#8220;Admitted&#8221; by this Court<br \/>\n\ton 8.2.2011.\n<\/p>\n<p>In the aforesaid backdrop,<br \/>\n\tCriminal Misc. Application (for condonation of delay) is listed for<br \/>\n\tadmission hearing after the above numbered Criminal Appeal is<br \/>\n\talready &#8220;Admitted&#8221; by this Court on 8.2.2011.\n<\/p>\n<p>Having<br \/>\n\tconsidered the submissions advanced by Mr. G.P.Baghel, learned<br \/>\n\tAdvocate for the Applicant and Mr. L.B.Dabhi, learned APP for the<br \/>\n\tRespondent &#8211; State of Gujarat, and<br \/>\n\ta perusal of the averments made in the application, which have<br \/>\n\tremained uncontroverted and also the celebrated principle governing<br \/>\n\tthe discretionary exercise of power conferred under Section 5 of the<br \/>\n\tAct so also the reported decisions of the Supreme Court construing<br \/>\n\tSection 5 of the Act liberally, according to us,  the Applicant has<br \/>\n\tshown sufficient cause for condonation of delay in filing the above<br \/>\n\tnumbered Criminal Appeal.  The record does not indicate that there<br \/>\n\twas inaction or negligence on the part of the Applicant in<br \/>\n\tprosecuting the Appeal.
