The partieswill   to  qoer their\n\nranking  \n3.  The plaintiff sought for recovery\n\nof Rs,2'v5,6044,\/f' w'1thD\"v_ Coats on the ground that the\n\n:_'j\"II'defenDd'ar:.te. reguesItei:I\"\"the plaintiff Bank by making an\n\neepigleiatienlfemeen of Rs. 1e,0oo\/- on 1842-1997 and the\n\n  plaintiff  eanctioned the same. The sanctioned loan\n\n se.nt_.D:'to one Asian Electronics and the defendant\n\n0  e:.pe1Vfe\u00bbha5sed BPL 21\" colour TV. The defendant had availed\n\n\n\nthe term loan and failed to repay the loan amount as\n\nagreed with interest at the rate of 13.32%, \n\nexecuted the necessary documents and as si:.ch,j*isVVi'li'ab14e \" \n\nto pay the said amount.\n\n4.\n\ufb01led his written statement int4eraliaV.._vstating he had\nnot purchased the Colour Electronics and\nnever agreed togpay denied the loan\ntransactiong.    Electronics is a\nnecessary-partyMto'1i:the \u00abHe-specifically denied having\npurchased the  which the loan was paid to\n\nthe Asian  basis of these pleadings, the\n\n  framed 'the following issues.\n\n ._  the plaintiff proves that 15E defendant\nA V__va*.ra\u00a72led consumer loan and 211$ defendant\n\" _ undertook to deduct the monthly instalment\n\namount as contended in the plaint'?\n\nThe defendant on \"s_ervic'e- of s1':%._itVV.i\ufb01sezmn1ons,'w.l'\n\n\n\n4\n\n2. Whether the plaintiff is entitled to the\n\ncompound rate of interest as claimed?\n\n3. Whether there is no cause of action \nsuit'?  W   \n4. Whether the defendants are a_nd'~\nseverally liable to pay the suit 'clainfamouritH\":\nas prayed for'? 1  if if if  \n5. What order or decreev?'p:;\"\"~-is   \n5. On behalf of the  the-_Man'ager was\nexamined as PW.1  .\/were marked in\n\nplaintiffs e'\\Vridence,_ the defendant, defendant\n\nwas exajnined as VDlW_._\"however, no documents were\n\nmarked ; The ;f'ria_l\"Clonrt held that the plaintiff has proved\n\n the ideferidant has availed the loan and the defendant\n\nti'i1dertool\u00a7'_to_ dileiduct the monthly installment amount as\n\nV dd _ contende--dii1\"\"the plaint and the plaintiff is entitled for 12%\n'\u00abV'f'\ufb02ir:1te1'e4st from the date of suit and 6% on the decreetal\n and accordingly decreed the suit. It is against the\n\n\" judgment and decree, the defendant is in appeal.\n\nf \\\n\n\n\n6. Learned counsel for the defendant submitted\n\nthat from the documents produced by \n\nappears that the loan was sanctioned and  V' \n\nAsian Electronics. Asian Electroitics is  a party\nand there is no delivery' amount\nwas alleged to have  Since it is\nhypothecation   delivered, the\nBank is not   From the material\nproducedlllhv  it j does not prove that Asian\n\nElectronics ..had del_iver0d.\"a'ny.JColour TV to the defendant.\n\nIn thisireglardq he relied on two orders passed by this\n\n:n'ic3\u00a7\u00a7p.t1295\/2004 dated 31-10-2006 and CRP\n\n3A3'65'\/.;300f\u00a7\"'andl.:;'connected matters dated 17-01-2006 and\n\nA submitted-fAtha't in identical circumstances and in respect\n\nllsimilarylllloans released by the Bank against Asian\n\n.'.E1e'ctro'nics, the Trial Court itself has dismissed the suit\n\n against the dismissal the Bank had filed revision\n\n\n\npetitions and this Hon'ble Court has confirmed the\n\ndismissal of the suit. He submitted that there .i.s\":no-\ufb02otlrier\n\nmaterial to distinguish the case from the judgn}j1en*tV.:in  \n\n295\/2004 and other connected\" l\u00ab}r_Ie_\":Vals'o '\n\nsubmitted that in nearly 30 other sixnliiar matters, *ti1'el'su'it--V.r\n\nhas been dismissed and it hase\u00abr.attained* .finaliity;'jHowever.\n\nthe Trial Court as against  haslldecreed the\nsuit on the verysame   that the\njudgment and  toithe judgment and\nalso there  loan from the\ndefenda:,tit,\"V'ou'&lt;sji;.f;  the suit and hence,\n\norder of Trial Court  to be set aside.\n\n  Qn the-....other hand, the learned counsel\n\nv.&quot;appVelaring:_&quot;fo1*wIthe Bank submitted that the Bank has\n\nprodueed  to R141\u00bb evidencing the sanction of loan,\n\ndoisburseinent of loan amount and hypothecation\n   dated 18-12-1997 and these documents do\n\n  the loan transaction between the plaintiff and\n\nrgwi\n\n\n\nit _agreernent:.&#039;1&#039;equires delivery of goods which\n\n If there is no delivery and\n\nthe defendant and submitted that the judgmentyy and\n\ndecree of the Trial Court does not call for interfe.renc&#039;_c.&quot;V;~ &quot; \n\n8.\nappeal is:\n&quot;Whether the judgmentpvand decree Trial\n\nCourt warrants interfer_ence?&quot;_...__  \n\n9. It is also not in dispute that\n\n  specifically taken a plea that no such\n\n to the defendant. Any hypothecation\nare\n\nif there is no\n\nevidelnce to show that such delivery was made, the\n\n&quot;-\u00abhypothecation agreement does not confer any right on the\n\nThe point that arises for ,consideration&quot;u &#039; . \n\nr%\u00a2i\n\n\n\nBank to recover the amount. It is not disputed that the\nrecovery was sought from defendant and \nplaced other defendants who are the V&#039;\nM.S.Ramaiah Medical College on the  C\navailed the loan for purchase of e1ectri&#039;c_a&#039;l  pp\nElectronics. But Asian E1ectro\u00abr1:ic\u00bbs is r1e.i_the.r  nor\nthere is any materialihto  &#039;colour TV is\ndelivered to the  taking into\nconsideration    has dismissed\nthe suit.  also dismissed the\nsimilar material placed before this\nCourt to\u00bb  judgment passed in the\n\nabove; matters.&#039;-.ln&quot;these circumstances, when there is no\n\n    of goods under hypothecation agreement\n\n matters, this Court having confirmed the\n\n _ dismissa,i\u00b0of.the suit, I do not find any reason to differ With\n\n  ,s_ame; &quot;Accordingly, this appeal deserves to be allowed.\n\n   I pass the following: \u00e9w\n\n1-A\n\n\n\nORDER\n<\/pre>\n<p>The appeal is allowed.
