Justice M.SASIDHARAN NAMBIAR\n\n Dated :24\/06\/2009\n\n O R D E R\n              M.SASIDHARAN NAMBIAR,J.\n            ===========================\n           CRL.M.C.No. 2036       OF 2009\n            ===========================\n\n      Dated this the 24th     day of June,2009\n\n                        ORDER\n<\/pre>\n<p>    Petitioner is the accused and second respondent<\/p>\n<p>the complainant in S.T.551\/2009 on the file of Judicial<\/p>\n<p>First Class Magistrate-II, Hosdurg.  Learned Magistrate<\/p>\n<p>took cognizance of the offence under section 138 of<\/p>\n<p>Negotiable Instruments Act on Annexure 1 complaint<\/p>\n<p>filed by the second respondent.  This petition is filed<\/p>\n<p>under section 482 of Code of Criminal Procedure to<\/p>\n<p>quash the complaint or in the alternative to transfer<\/p>\n<p>the case to Judicial First Class Magistrate Court,<\/p>\n<p>Aluva  on   the  ground  that   Judicial  First   Class<\/p>\n<p>Magistrate-II, Hosdurg has no territorial jurisdiction<\/p>\n<p>to take cognizance of the offence or to Aluva try the<\/p>\n<p>case.   The argument of the petitioner is that the<\/p>\n<p>entire  transaction   has   taken  place   within   the<\/p>\n<p>jurisdiction of the Judicial First Class Magistrate<\/p>\n<p>Court Aluva    and the fact that second respondent<\/p>\n<p>presented the cheque for encashment through his bank at<\/p>\n<p>Nileshwar will not enable the Magistrate to try the<\/p>\n<p>case.\n<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.2036\/2009               2<\/span><\/p>\n<p>      2.   On hearing the learned  counsel, I do not find any<\/p>\n<p>reason    either   to  quash the  case   or to  transfer  the<\/p>\n<p>complaint as sought for.       The components constituting an<\/p>\n<p>offence under section 138 of Negotiable Instruments Act<\/p>\n<p>include    the   demand  for    the  amount  covered  by  the<\/p>\n<p>dishonoured cheque, in writing.        Unless the amount is<\/p>\n<p>demanded there cannot be a failure to pay it    by the drawer<\/p>\n<p>of the cheque. A       complainant is entitled to demand the<\/p>\n<p>amount covered by the dishonoured cheque,         on getting<\/p>\n<p>information of the dishonour, from the place where         he<\/p>\n<p>resides or works.       When    first respondent is residing<\/p>\n<p>within     the   jurisdiction  of     Judicial  First   Class<\/p>\n<p>Magistrate, Hosdurg he is definitely entitled to demand the<\/p>\n<p>amount covered by the dishonoured cheque in writing from<\/p>\n<p>Hosdurg.
