No. 2543 OF 2005 C\n                 ````````````````````````````````````````````````````\n             Dated this the 16th day of November, 2007\n\n                                   O R D E R\n<\/pre>\n<p>            The    revision      petitioner,     who      was     the accused in<\/p>\n<p>C.C.No.114\/2002 on the file of the JFCM-I, Haripad for an offence<\/p>\n<p>punishable under section 138 of the Negotiable Instruments Act, 1881,<\/p>\n<p>challenges the conviction entered and the sentence passed against him<\/p>\n<p>concurrently by the trial court for the said offence.<\/p>\n<p>      2.    Pending this revision, the parties have settled the matter<\/p>\n<p>and have filed Crl.M.A.No.12043\/2007 under section 147 of the Act for<\/p>\n<p>recording the composition entered into by them. The said petition has<\/p>\n<p>been signed by both the revision petitioner as well as the complainant<\/p>\n<p>and their respective counsels. The composition is recorded and it will<\/p>\n<p>have the effect of an acquittal within the meaning of section 320(8)<\/p>\n<p>Cr.P.C. The sum of Rs.78,750\/- (Rupees seventy eight thousand seven<\/p>\n<p>hundred and fifty only) deposited by the revision petitioner before the<\/p>\n<p>trial court  shall    be    permitted       to    be    withdrawn     by the 2nd<\/p>\n<p>respondent\/complainant as agreed to in the compounding petition.<\/p>\n<p>      This revision petition is disposed of as above.<\/p>\n<p>                                                       (V.
