{"id":166725,"date":"2010-08-12T00:00:00","date_gmt":"2010-08-11T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/maharishi-durwasha-jan-evam-pashu-vs-zila-panchayat-auraiya-and-others-on-12-august-2010"},"modified":"2018-05-08T05:41:20","modified_gmt":"2018-05-08T00:11:20","slug":"maharishi-durwasha-jan-evam-pashu-vs-zila-panchayat-auraiya-and-others-on-12-august-2010","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/maharishi-durwasha-jan-evam-pashu-vs-zila-panchayat-auraiya-and-others-on-12-august-2010","title":{"rendered":"Maharishi Durwasha Jan Evam Pashu &#8230; vs Zila Panchayat Auraiya And Others on 12 August, 2010"},"content":{"rendered":"<div class=\"docsource_main\">Allahabad High Court<\/div>\n<div class=\"doc_title\">Maharishi Durwasha Jan Evam Pashu &#8230; vs Zila Panchayat Auraiya And Others on 12 August, 2010<\/div>\n<pre>Court No. - 29\n\nCase :- WRIT - C No. - 44129 of 2010\n\nPetitioner :- Maharishi Durwasha Jan Evam Pashu Mela Auraiya And Ors.\nRespondent :- Zila Panchayat Auraiya And Others\nPetitioner Counsel :- Gautam Chaudhary,Anil Bhushan\nRespondent Counsel :- C.S.C.,A.K.Srivastava,Anshu Chaudhary,Nisaruddin\n\nHon'ble Sheo Kumar Singh,J.\n<\/pre>\n<p>Hon&#8217;ble Devendra Kumar Arora,J.\n<\/p>\n<p>Heard learned counsel for the petitioner and Sri Anshu Chaudhary, learned<br \/>\nadvocate for Zila Panchayat and Sri Nisar Uddin, learned advocate who<br \/>\nappeared for the private respondent.\n<\/p>\n<p>Challenge in this petition is the order dated 2.6.2010 passed by Zila<br \/>\nPanchayat by which application for grant of permission to hold cattle market<br \/>\non the land in dispute for the year 2010-2011 has been rejected.\n<\/p>\n<p>Submission of learned counsel for the petitioner is that order of Zila<br \/>\nPanchayat is non speaking and there is total non application of mind to the<br \/>\nfacts qua petitioner and the private respondent.\n<\/p>\n<p>Submission is that the only reason which has been given in the order<br \/>\nimpugned here is that because license in favour of private respondent has<br \/>\nbeen renewed, application of the petitioner cannot be accepted .\n<\/p>\n<p>Submission is that firstly, renewal as is said to have been done by Zila<br \/>\nPanchayat is totally illegal and unjustified for the simple reason that renewal<br \/>\ncan be of continuing fact.It is the permission to hold cattle market is given<br \/>\nevery year only for limited days ( 20 days) and thus , it can be a case of fresh<br \/>\ngrant every year on satisfaction of various details and comparative merits of<br \/>\nthe applicants applying for the permission.\n<\/p>\n<p>Submission is that so far as petitioner is concerned, his claim may be accepted<br \/>\nto be much better to that of private respondent as so far land is concerned,<br \/>\npetitioner has major share and the respondent has very small share and<br \/>\notherwise also, financial capacity may weigh in petitioner&#8217;s favour.\n<\/p>\n<p>Submission is that this may be for consideration by the competent authority<br \/>\nand he is not asking this Court to examine the merits between the petitioner<br \/>\nand the respondent to whom license has been given.\n<\/p>\n<p>Sri Chaudhary and Sri Nisar Uddin, learned counsel for the respondents<br \/>\nsubmit that in the bye laws, there is mention for renewal and as for the<br \/>\nprevious year, petitioner did not apply, if license has been renewed in favour<br \/>\nof private respondent, then no exception can be taken to it.\n<\/p>\n<p>At the very outset, this Court is to observe that non applying and non grant of<br \/>\nlicense\/permission of previous year, may not be the ground for non<br \/>\nacceptance of the claim of the petitioner for this year. If permission is to be<br \/>\ngranted every year, then non moving application of previous year may not be<br \/>\n a ground for non consideration of the claim of petitioner for the next year.\n<\/p>\n<p>Petitioner claims to have better claim than the private respondent for various<br \/>\nreasons about which, we are not to express any opinion and lay down any<br \/>\ncriteria\/guideline as that can be matter of concern\/discretion of the Zila<br \/>\nPanchayat but at the same time, Zila Panchayat will have to act in a<br \/>\nreasonable manner while granting\/rejecting claim of either of the claimant.\n<\/p>\n<p>A bare perusal of the order of Zila Panchayat makes it clear that absolutely no<br \/>\nreason has been given for rejecting the petitioner&#8217;s claim and thus the manner<br \/>\nin which, petitioner&#8217;s claim has been rejected, is not acceptable to this Court<br \/>\nas the matter\/claim has to be considered objectively and thus documents i.e.<br \/>\nKhatauni extract and other things as is required to be presented as provided in<br \/>\nthe bye-laws is to be taken into account by the Zila Panchayat while<br \/>\nconsidering the claim.\n<\/p>\n<p>Grant of license to the private respondent on the ground so noticed in the<br \/>\nimpugned order is to be quashed.\n<\/p>\n<p>Accordingly, this petition succeeds and is allowed.\n<\/p>\n<p>The impugned order dated 2.6.2010 is quashed.
