Justice P.N.RAVINDRAN\n\n Dated :14\/07\/2008\n\n O R D E R\n            J.B.KOSHY &amp; P.N.RAVINDRAN, JJ.\n                  -------------------------------\n                 W.A.NO.1781 OF 2004 ()\n                                &amp;\n              C.M.APPLN.NO.1958 OF 2004\n                -----------------------------------\n           Dated this the 14th day of July, 2008\n\n                      J U D G M E N T\n<\/pre>\n<p>KOSHY,J.\n<\/p>\n<\/p>\n<p>      For the reasons stated in the affidavit, delay is condoned.<\/p>\n<p>      Petitioner  entered    service    as    a   P.D.teacher  in<\/p>\n<p>Government     Lower Primary Girls School, Pathanamthitta.<\/p>\n<p>His regular service started with effect from 31.7.1974.<\/p>\n<p>Petitioner had provisional service of two years, two months<\/p>\n<p>and nine days. Taking into account the provisional service, he<\/p>\n<p>was granted annual increments as per order No.K.Dis.729\/86<\/p>\n<p>dated 10.2.1986, and by Ext.P1, his pay was fixed.        After a<\/p>\n<p>lapse of more than eight years, objections were raised and<\/p>\n<p>petitioner was asked to repay the excess pay. The learned<\/p>\n<p>Single Judge after considering the Government Order dated<\/p>\n<p>10.2.1986 and also as per the decision in <a href=\"\/doc\/1826130\/\">Hussain v. Kerala<\/p>\n<p>                     W.A.NO.1781 OF<\/a> 2004 ()<br \/>\n                              &amp;<br \/>\n                   C.M.APPLN.NO.1958 OF 2004<\/p>\n<p><span class=\"hidden_text\">                              2<\/span><\/p>\n<p>Water Authority (1996 (2) KLT 555) held that petitioner is<\/p>\n<p>entitled to increments taking into account of the provisional<\/p>\n<p>service. We see no ground to interfere in the above. We also<\/p>\n<p>note that he has exercised re-option as per Government Order<\/p>\n<p>dated 5.2.1999 and he got the benefit of re-option from the<\/p>\n<p>date   of   entitlement  as   held    in   the judgment     in<\/p>\n<p>O.P.No.8951\/2002 and connected cases. Same view was also<\/p>\n<p>accepted in <a href=\"\/doc\/866984\/\">State of Kerala and Others v. Lissy Joseph M.<\/a><\/p>\n<p>(2006 (1) KLJ 566).      The objection itself was raised after<\/p>\n<p>eight years.
