The petitioners have prayed for direction on the respondent-<br \/>\nUniversity to pay the balance retiral dues including the difference of pay<br \/>\nand pension payable to the petitioners on the U.G.C. revised scale.\n<\/p>\n<p>          It has been submitted that the petitioners (husband of the<br \/>\npetitioner in W.P.(S) No.1231\/2011 and father of the petitioners in W.P.<br \/>\n(S) No.1362\/2011) were teachers in G.L.A. College, Daltonganj. They<br \/>\nretired on attaining the age of superannuation. After their retirement the<br \/>\npetitioners were entitled to get the arrears of service period as also the<br \/>\nretiral    benefits,   but   in   spite   of    their   repeated   requests   and<br \/>\nrepresentations, full retiral dues have not been paid to them till date.<br \/>\nEven in the cases in which retiral dues have been partly paid, the same<br \/>\nwere not calculated on the basis of revised UGC scale which is<br \/>\napplicable to the petitioners.\n<\/p>\n<p>          Learned counsel appearing on behalf of Ranchi University<br \/>\nsubmitted that now in view of creation of Nilambar-Pitambar University,<br \/>\nthe said University has to consider the petitioners&#8217; claim and pay the<br \/>\nbalance dues to the petitioners.\n<\/p>\n<p>          Learned counsel appearing on behalf of Nilambar-Pitambar<br \/>\nUniversity, on the other hand, submitted that some of the petitioners<br \/>\nretired from Ranchi University and, as such, Ranchi University is liable<br \/>\nfor payment of the dues claimed by the petitioners. However, learned<br \/>\ncounsel for the said University submitted that the petitioners&#8217; respective<br \/>\nclaims shall be considered by them and appropriate order shall be<br \/>\npassed in accordance with law.\n<\/p>\n<p>          In view of the said submissions of learned counsel for the<br \/>\nUniversity, this batch of the writ petitions is disposed of directing the<br \/>\nUniversities to consider the claim of the petitioners and pass appropriate<br \/>\norder in accordance with law within a period of six weeks from the date<br \/>\nof receipt of the representation.\n<\/p>\n<p>          It is made clear that the concerned University shall be that<br \/>\nUniversity, from which the petitioner(s) retired. Even if in the cases that<br \/>\nthe claim is payable by both the Universities, the same shall be settled<br \/>\nbetween the Universities. But in any event, the claim shall be payable to<br \/>\nthe petitioner(s) by the University from which he\/they retired. On<br \/>\nconsideration of the petitioners&#8217; claim, the amount found payable to them<br \/>\nshall be paid to the petitioner(s) within a period of two months from the<br \/>\ndate of disposing of his\/their claim by the respondent(s) with statutory<br \/>\ninterest.\n<\/p>\n<p><span class=\"hidden_text\">                                             -3-<\/span><\/p>\n<p>                If the admitted amount(s) is\/are not paid to the petitioner(s) within<br \/>\n          the said period, the petitioner(s) shall be entitled to get compensatory<br \/>\n          interest @ 10% per annum in addition to the statutory interest calculated<br \/>\n          from the date the amount(s) found due till the date of actual payment.\n<\/p>\n<p>                The Universities shall be at liberty to recover the amount of<br \/>\n          compensatory interest from the erring officials.\n<\/p>\n<p>                It goes without saying that if the University has to get any amount<br \/>\n          from the State Government, it must submit a requisition well within time<br \/>\n          and if it is found that the amount is payable by the State Government,<br \/>\n          the concerned authorities of the State Government shall take immediate<br \/>\n          step to release the amount, so that the arrears of the retired teachers be<br \/>\n          cleared within the prescribed period, aforesaid.\n<\/p>\n<p>                                                      (Narendra Nath Tiwari, J)<br \/>\nShamim\/\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Jharkhand High Court Mrs.Tunuka Devi vs State Of Jharkhand &amp;
