BASANT, J.\n                  - - - - - - - - - - - - - - - - - - - - - -\n                      B.A.No. 122 of 2008\n                  - - - - - - - - - - - - - - - - - - - - - -\n             Dated this the 14th day of January, 2008\n\n                               O R D E R\n<\/pre>\n<p>      Application for anticipatory bail. The petitioner, a woman,<\/p>\n<p>faces allegations under the Kerala Abkari Act. The petitioner<\/p>\n<p>was allegedly found to be in possession of 5 litres of arrack on<\/p>\n<p>22.12.2007. She was not arrested by the detecting officials as the<\/p>\n<p>detecting Excise party did not consist of any woman official.<\/p>\n<p>Investigation is in progress. The petitioner apprehends imminent<\/p>\n<p>arrest. The petitioner has no history of any criminal antecedents,<\/p>\n<p>submits the learned Prosecutor.\n<\/p>\n<p>      2. The learned counsel for the petitioner submits that the<\/p>\n<p>petitioner is innocent. He prays that anticipatory bail may be<\/p>\n<p>granted to the petitioner.\n<\/p>\n<p>      3. The learned Prosecutor opposes the application. The<\/p>\n<p>allegations clearly reveal the commission of the crime.          The<\/p>\n<p>petitioner may be directed to surrender before the learned<\/p>\n<p>Magistrate and seek regular bail in the ordinary course, submits<\/p>\n<p>the Prosecutor.\n<\/p>\n<p>B.A.No. 122 of 2008<br \/>\n<span class=\"hidden_text\">                                   2<\/span><\/p>\n<p>      4.   I find merit in the opposition by the learned Prosecutor. I<\/p>\n<p>agree with the learned Prosecutor that there are no features in this<\/p>\n<p>case, which would justify the invocation of the extra ordinary equitable<\/p>\n<p>discretion under section 438 Cr.P.C. in favour of the petitioner. This<\/p>\n<p>I am satisfied is a fit case where the petitioner must resort to the<\/p>\n<p>ordinary and normal procedure of appearing before the Investigator or<\/p>\n<p>the learned Magistrate having jurisdiction and then seek regular bail in<\/p>\n<p>the ordinary course.\n<\/p>\n<p>            6. This application is accordingly dismissed.        I may<\/p>\n<p>however hasten to observe that if the petitioner appears before the<\/p>\n<p>learned Magistrate and applies for bail after giving sufficient prior<\/p>\n<p>notice to   the   Prosecutor   in charge of the case,     the   learned<\/p>\n<p>Magistrate must proceed to pass orders on merits, in accordance with<\/p>\n<p>law and expeditiously.\n<\/p>\n<\/p>\n<p>                                             (R.
