3. Subsequent to the  filed an
\napplication under     of the
\npetition by  of The Family Court
\nunder   -0 15.09.2010 dismissed the<\/p>\n
application foroaniendmentilonlihlthei0 ground that it is highly belated.<\/p>\n

4. Heard arguments on both the side and perused the ent-ir_ei~.t_<\/p>\n
writ papers. _<\/p>\n
5. Petitioner is the husband of respondent and   <\/p>\n
minor child by name Vathan. Since differgencesarose b.etytteen stile’ <\/p>\n
petitioner and respondent, they got separated*__and   ll<\/p>\n
remained with the respondent. Therefo1~.3:”ihe pevtitigy\ufb01ercf’i_led’Cl”and
\nWC No. 106\/2004 for custody ofthe .rni’1i()r* tfhi.ld”under sectiori 25 of
\nthe Act. It is also seen from the record’tha’t:on’_.cei’tai.nl interim orders<\/p>\n
the matter reached th.is’Co’_urt and while  those matters, this<\/p>\n
Court directed the Falniliciiy.Court’-.to’dispose the entire matter within a
\ntime frame of two months.\n<\/p>\n
 in  impugned order at Annexure C the Family Court<\/p>\n
. upheld lthe \u00abobjeetion:i;’1’aised by learned counsel for the respondent to<\/p>\n
certain ti{i1est;i.loi1sv”put to R.W.l on the ground that there is no<\/p>\n
 ‘I’he'”questions put by learned counsel for the petitioner to<\/p>\n
 was in relation to the health condition of the minor child.<\/p>\n

Further the heal.th condition of the minor child are all subsequent.<\/p>\n
developments during the pendency of the petition before  ~<\/p>\n
Court. In the matter of adjudicating the custody of the mi-nor   V’<\/p>\n
is necessary for the Family Court to decide \u00bbthe._heal,thlcorrdition of<\/p>\n
the child. In the circumstances the questions re’lating’eato the hlealth <\/p>\n
condition of the child and that too when the.ylapre”subseqpu”ent ‘e’\\Jent:’:i., <\/p>\n
the objection raised by the learned cou-riselphl’or the._respondeht”to”‘the
\nquestions put to R.W.l are unsustaina.b.le’;vT[‘h’erefore “t’lie_pimpugned
\norder sustaining the objections lltaipsed lily: learneldi counsel for the<\/p>\n
respondent to the questions put_to_  r:}qu–i’res  jVbel*’quashed.<\/p>\n
7. The impu’gnedA3′.orderknat Annexure H is rejecting the<\/p>\n
application for_  the petitioner. The proposed<\/p>\n
amendment is to ineorporlatelfacts relating to health condition of the<\/p>\n
 thegtreatment given to the minor child, and the<\/p>\n
negligence towards minor child. These events had<\/p>\n
 taken pl.ace,.__duriiri’gi the pendency of the petition before the Family<\/p>\n
H  ‘Co’urt, It is settled position of law that it is obligatory on the part of<\/p>\n
&N\\<\/p>\n
the Court to consider the subsequent events even without therevbeinig.<\/p>\n
pleadings when they are brought in evidence. “fhere;t’o’re-,f_~ <\/p>\n
