Justice KURIAN JOSEPH\n\n Dated :06\/06\/2007\n\n O R D E R\n                                   KURIAN JOSEPH, J.\n\n                     -----------------------------------------\n\n                           W.P(C)No.26503  of  2003\n\n                     -----------------------------------------\n\n                    Dated this the 6th day of  June, 2007\n\n\n                                      JUDGMENT\n<\/pre>\n<p>        The writ petition is filed mainly with the following prayers:-<\/p>\n<p>                           ii)      issue   a   writ   of   mandamus   or   any   other<\/p>\n<p>                   appropriate   writ,   order   or   direction   commanding   the   first<\/p>\n<p>                   respondent   to   direct   the   3rd  respondent   to   refund   to   the<\/p>\n<p>                   petitioner   the   entire   amount   collected   by   the   3rd  respondent<\/p>\n<p>                   from the petitioner with 12% interest, till the date of payment;<\/p>\n<p>                           iii)     issue   a   writ   of   mandamus   or   any   other<\/p>\n<p>                   appropriate   writ,   order   or   direction   to   direct   the   first<\/p>\n<p>                   respondent   to   consider   and   take   a   decision   on   Ext.P11   in<\/p>\n<p>                   accordance with law and issue appropriate direction to the 3rd<\/p>\n<p>                   respondent, immediately.\n<\/p>\n<p>\nSince Ext.P11 is pending before the first respondent, the writ petition<\/p>\n<p>is  disposed  of   directing  the  first   respondent  to  consider  Ext.P11   with<\/p>\n<p>notice   to   the   petitioner   and   the   3rd  respondent   and   pass   appropriate<\/p>\n<p>orders thereon  in accordance with law and communicate the same to<\/p>\n<p>the petitioner and the 3rd  respondent within a period of three months<\/p>\n<p>from   the   date   of   production   of   a   copy   of   the   judgment.
