SHAH\n\t\t\n\t\n\n \n\nDate\n: 28\/11\/2008 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\t\tPresent<br \/>\nCivil Revision Application is filed by the petitioners ?  original<br \/>\nplaintiff challenging the order passed by the learned Additional<br \/>\nCivil Judge and JMFC, Surendranagar dated 31.07.2007 passed below<br \/>\nExh.11 in Civil Misc.Application No.1 of 2005, by which the learned<br \/>\ntrial Court has dismissed the application submitted by the petitioner<br \/>\n?  plaintiff to restore the Suit which came to be dismissed for<br \/>\nnon-prosecution and as the learned Advocate for the petitioners who<br \/>\nwas suffering from typhoid did not remain present on 09.12.2004.\n<\/p>\n<p>2.\t\tThough<br \/>\nserved nobody appears on behalf of the respondents. Vide order dated<br \/>\n09.12.2004, Regular Civil Suit No.11 of 2000 came to be dismissed for<br \/>\nnon-prosecution by the learned trial Court as neither the learned<br \/>\nAdvocate for the petitioner nor the petitioner remained present.<br \/>\nSubsequently the petitioner submitted application being Civil<br \/>\nMisc.Application No. 1 of 2005 before the learned trial Court for<br \/>\nrestoring the said Suit by submitting that the learned Advocate for<br \/>\nthe petitioner was suffering from typhoid and therefore, she could<br \/>\nnot remain present nor she could inform the petitioner about the date<br \/>\nof hearing. The learned trial Court dismissed the said application by<br \/>\nholding that the petitioner- plaintiff has not filed any supporting<br \/>\naffidavit with respect to sickness of the learned Advocate. It<br \/>\nappears that being aggrieved and dissatisfied with the order passed<br \/>\nby the learned trial Court on 31.07.2007 passed in Civil<br \/>\nMisc.Application No.1 of 2005, the petitioner by mistake preferred<br \/>\nAppeal from Order before the learned District Judge, Surat which came<br \/>\nto be dismissed by the learned Additional District Judge, Fast Track<br \/>\nCourt No.1, Surendranagar vide order dated 14.08.2008 on the<br \/>\nground that same is not maintainable, hence, the petitioner has<br \/>\npreferred present Civil Revision Application mainly challenging the<br \/>\norder passed by the leaned trial Court passed below Civil<br \/>\nMisc.Application No.1 of 2005 by which the learned trial Court has<br \/>\nnot restored the suit to file. Considering the impugned order passed<br \/>\nby the learned trial Court in Civil Misc.Application and the cause<br \/>\nshown that the learned advocate for the petitioner was suffering from<br \/>\ntyphoid and therefore, she could not remain present on 09.12.2004 the<br \/>\ndate on which hearing of the suit was fixed and considering above,<br \/>\nthe learned trial Court ought to have restored the suit to file and<br \/>\nought to have proceeded further with the hearing of the suit on<br \/>\nmerits. It appears that the learned trial Court has taken too<br \/>\ntechnical view in considering the restoration application. It is<br \/>\nrequired to be noted that it is not finding of the learned trial<br \/>\nCourt that the petitioner and their Advocate has deliberately with a<br \/>\nview to delay the proceedings did not remain present. In view of<br \/>\nabove, the learned trial Court ought to have allowed the restoration<br \/>\napplication and ought to have restored the suit to file.\n<\/p>\n<p>3.\t\tUnder<br \/>\nthe circumstances and for the reasons stated above, impugned order<br \/>\ndated 31.07.2007 passed below Exh.11 in Civil Misc.Application No.1<br \/>\nof 2005 passed by the learned trial Court is hereby quashed and set<br \/>\naside and Regular Civil Suit No.11 of 2000 is restored to file. Now<br \/>\nthe learned trial court to decide and dispose of the suit in<br \/>\naccordance with law and on merits. Mr.Gateshaniya, learned Advocate<br \/>\nfor the petitioner has submitted that the petitioner will give<br \/>\nfullest cooperation to the learned trial Court for early disposal of<br \/>\nthe suit and they will not ask for unnecessary adjournment. Rule is<br \/>\nmade absolute.
