JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 10\/09\/2008 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>This<br \/>\n\tapplication has been filed by the applicants, with a prayer to bring<br \/>\n\ton record, respondent nos. 4\/1 to 4\/5, as the heirs and legal<br \/>\n\trepresentatives of deceased respondent no.4 ?  Govindbhai<br \/>\n\tNarsinhbhai Patel.\n<\/p>\n<p>This<br \/>\n\tCourt has issued Rule on 25.7.2008.  The endorsement on the board<br \/>\n\tindicates that the notice of Rule has been served upon respondent<br \/>\n\tno.7.  Ms. Sejal K. Mandaviya, learned counsel appears for<br \/>\n\trespondent no.7.  However, none appears for the other respondents.\n<\/p>\n<p>I<br \/>\n\thave heard Ms. Sonal D. Vyas, learned counsel for the applicant and<br \/>\n\thave perused the averments made in the application.\n<\/p>\n<p>The<br \/>\n\tapplication is accompanied by a copy of the death certificate of the<br \/>\n\tdeceased respondent no.4, indicating that the said Govindbhai<br \/>\n\tNarsinhbhai Patel, expired on 12.8.2006.  The respondent nos. 4\/1 to<br \/>\n\t4\/5, as described in the memorandum of parties to the Civil<br \/>\n\tApplication, are the heirs and legal representatives of the deceased<br \/>\n\trespondent no.4.  It is submitted by the learned counsel for the<br \/>\n\tapplicant, that the applicant has also preferred Civil Application<br \/>\n\tNo. 5922 of 2008, for condonation of delay in filing the Second<br \/>\n\tAppeal, in which the Court has issued notice, and only at that<br \/>\n\tstage, the applicant came to know about the death of respondent<br \/>\n\tno.4, who could not be served as he had expired.\n<\/p>\n<p>In<br \/>\n\tview of the submissions made by the learned counsel for the<br \/>\n\tapplicant, the application deserves to be allowed.  Accordingly, the<br \/>\n\tapplication is allowed.  The respondent nos. 4\/1 to 4\/5 are brought<br \/>\n\ton record as the heirs and legal representatives of deceased<br \/>\n\trespondent no.4 ?  Govindbhai Narsinhbhai Patel.  The necessary<br \/>\n\tamendment may be carried out in the memorandum of the Civil<br \/>\n\tApplication for condonation of delay, as well as in the Second<br \/>\n\tAppeal.
