(J)\n\nCITATION:\n 1996 SCALE  (5)498\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Eight writ\t petitions were allowed by Division Bench of<br \/>\nthe  Patna  High  Court\t holding  that\tthe  Rules  for\t the<br \/>\nestablishment of  Saw-pits and\testablishment and regulation<br \/>\nof depots  framed in  the year 1983 by the State Government,<br \/>\nBihar  in  purported  exercise\tof  powers  conferred  under<br \/>\nsections 41,  42 and  76 of the Indian Forest Act, 1927 were<br \/>\nin excess of delegation or authorisation, exceeding mandate,<br \/>\nand hence  a colourable\t exercise. On  the  basis  of  these<br \/>\nrules, a public notice was given by the Chief Conservator of<br \/>\nForest, Bihar  to the  effect that  the rules  required\t all<br \/>\nowners of Saw-pits and depots to obtain licences in terms by<br \/>\n28-2-1983, and\tas a consequence if any saw-pit or depot was<br \/>\nfound unlicensed  from 1-3-1983,  that would  attract action<br \/>\nand penalties  under the  rules. We  are required to examine<br \/>\nthe correctness or otherwise of such view of the High Court.\n<\/p>\n<p>     Straightaway, we  go to  the  Act\tand  the  provisions<br \/>\nwhereunder the\tState Government  claims to  have framed the<br \/>\n1983 rules.  As is  clear from\tthe prefatory portion of the<br \/>\nrulest those are sections 41, 42 and 76 of the Indian Forest<br \/>\nAct, 1927.  Section 41 empowers the State Government to make<br \/>\nrules to regulate the transit of forest produce. Sub-section<br \/>\n1 of  Section 41 provides that the State Government can make<br \/>\nrules regulating  the transit of all timber and other forest<br \/>\nproduce by  land or  water. Clause  (e) of  sub section\t (2)<br \/>\nprovides for  the establishment\t and regulation of depots to<br \/>\nwhich such  timber or other forest produce shall be taken by<br \/>\nthose in charge of it for examination, or for the payment of<br \/>\nsuch money,  or in  order that\tsuch marks may be affixed to<br \/>\nits and\t the conditions\t under which  such timber  or  other<br \/>\nforest produce\tshall be  brought to,  stored at and removed<br \/>\nfrom such  depots. Section  42 is  supportive of  Section 41<br \/>\ninasmuch as  it empowers the State Government to frame rules<br \/>\nprescribing penalties  for breach of the rules in 4 terms of<br \/>\npunishment of  imprisonment and imposition of fines. Section<br \/>\n76 apparently is all comprehensive for it provides the State<br \/>\nGovernment the\tadditional powers  to make rules. Clause (d)<br \/>\nthereof, authorises  the  State\t Government  to\t make  rules<br \/>\ngenerally, to carry out the provisions of the Act.\n<\/p>\n<p>     Now, the  High Court has taken the view that regulation<br \/>\nof the business of timber and forest produce at Saw-pits and<br \/>\ndepots, is  not covered\t by either  of\tthe  three  sections<br \/>\nabove-mentioned.\n<\/p>\n<p>     On hearing\t counsel for the parties on the subject, and<br \/>\ngiving our  earnest consideration,  we get  to the view that<br \/>\nthe conclusion\tof the High Court was totally erroneous. The<br \/>\nvariety of subjects provided in the sub-heads of sub-section<br \/>\n(2) of\tSection 41  are\t preluded  with\t the  expression  in<br \/>\nparticular and\twithout prejudice  to the  generality of the<br \/>\nforegoing power&#8221;.  wholesome, power  stands conferred on the<br \/>\nState Government  to make  rules under\tsub-section  (1)  of<br \/>\nSection 41 with regard to transit of timber and other forest<br \/>\nproduce by  land or  water. Conferral of such powers inheres<br \/>\nin it  the power  to frame rules in order to regulate places<br \/>\nfor stoppage, reporting examination and marking of timber or<br \/>\nother forest  produce. Necessarily,  duty, fee,\t royalty  or<br \/>\ncharges due  thereon become  due, if  imposed. In  order  to<br \/>\navoid breach  of the  rules, Section 42 gets into line. Then<br \/>\ncomprehensive power on the subject is given generally to the<br \/>\nState Government as additional powers to make rules to carry<br \/>\nout the\t provisions of\tthe Act.  No one can be permitted to<br \/>\ndeny that  regulating the activity of keeping a saw-pit or a<br \/>\ndepot is  not an  activity to  which the  provisions of\t the<br \/>\nIndian Forest  Act,  1927  would  not  be  attracted.  Thus,<br \/>\nrequiring all the saw-pit holders or depot holders to obtain<br \/>\nregulatory licences,  squarely fall  within  clause  (d)  of<br \/>\nSection 76,  if not, (without holding so) under the power to<br \/>\nregulate transit  by land  or air available under Section 41<br \/>\nof the\tAct. These  three provisions  namely Sections 41, 42<br \/>\nand 76\treflect\t an  integrated\t scheme\t to  carry  out\t the<br \/>\nprovisions of  the Act\tand as\tthe preamble  of the  Act is<br \/>\nsuggestive to  consolidate the laws relating to forests, the<br \/>\ntransit of  forest produce  and the  duty leviable on timber<br \/>\nand other  forest produce.  The power to regulate by license<br \/>\nthe upkeep  of saw-pits and Depots is in any event ancillary<br \/>\nto the\tmain power.  We, therefore,  have no  hesitation  to<br \/>\nupset the  view of  the High Court by allowing these appeals<br \/>\nand in\tthis manner dismissing the writ petitions which were<br \/>\npreferred by  the respondents  before the High Court. We are<br \/>\ndoing so  because it  is otherwise  not\t disputed  that\t the<br \/>\nsecond question\t framed by  the High  Court relating  to the<br \/>\nvires of  the Act  on the  touchstone of Articles 14, 19 and<br \/>\n301 of\tthe Constitution,  left undecided by the High Court,<br \/>\nis not\trequired to  be decided\t by us.\t We allow the appeal<br \/>\naccordingly.
