BASANT, J.\n\n              -------------------------------------------------\n\n                     CRL.M.C.NO. 1717 OF 2007\n\n              -------------------------------------------------\n\n               Dated this the 12th  day of June, 2007\n\n\n\n                                  ORDER\n<\/pre>\n<p>      The   petitioner   is  the   2nd  accused   in   a  prosecution   under<\/p>\n<p>Sec.56(b)   of   the     Kerala   Abkari   Act.       Altogether,   there   are<\/p>\n<p>three   accused   persons.       The   1st  accused   is   alleged   to   be   a<\/p>\n<p>licensee  and  the   3rd  accused   is  alleged   to   an   employee  of   the<\/p>\n<p>said toddy shop.   There is an allegation that the petitioner has<\/p>\n<p>taken over the shop of the 1st accused and is running the same<\/p>\n<p>and   the   3rd  accused   had   committed   the   offence   with   the<\/p>\n<p>knowledge and consent of the other accused.       The petitioner<\/p>\n<p>has   come   to   this   Court   with   a   prayer   that   the   powers   under<\/p>\n<p>Sec.482   of   the   Cr.P.C.   may   be   invoked   to   prematurely<\/p>\n<p>terminate the proceedings against the petitioner.       The short<\/p>\n<p>contention  raised by him is that Sec.56  of the  Abkari Act can<\/p>\n<p>apply only to a licensee or an employee of the licensee.   He is<\/p>\n<p>neither.   Hence the proceedings against him may be quashed,<\/p>\n<p><span class=\"hidden_text\"> CRL.M.C.NO. 1717 OF 2007  -: 2 :-<\/span><\/p>\n<p>it is prayed.\n<\/p>\n<\/p>\n<p>       2.   Sec.56 of the Abkari Act is not confined in its operation<\/p>\n<p>against the licensee.     It takes in person being the employee of<\/p>\n<p>such licensee and acting on his behalf.     Whether the allegation<\/p>\n<p>is   acceptable   or   not   is   a   totally   different   question.     But   at   the<\/p>\n<p>moment,   it   cannot   be   assumed   that   there   are   no   allegations<\/p>\n<p>against the petitioner to justify the charge under Sec.56(b) of the<\/p>\n<p>Abkari Act.     The prayer for quashing on that ground cannot, in<\/p>\n<p>these circumstances, succeed.\n<\/p>\n<\/p>\n<p>       3.   The learned counsel for the petitioner then submits that<\/p>\n<p>no materials have been placed before the learned Magistrate in<\/p>\n<p>the   final   report   under   Sec.173   of   the   Cr.P.C.   and,   in   these<\/p>\n<p>circumstances, it is prayed that the powers under Sec.482 of the<\/p>\n<p>Cr.P.C. may be invoked.\n<\/p>\n<\/p>\n<p>       4.     The copy of the report under Sec.173 of the Cr.P.C. is<\/p>\n<p>not placed before this Court.   The materials available along with<\/p>\n<p>the report under Sec.173 of the Cr.P.C.  are not revealed to this<\/p>\n<p>Court.     At   the   moment,   the   allegations   justify   the   raising   of   a<\/p>\n<p>charge   under   Sec.56(b)   of   the   Abkari   Act.      Whether   there   are<\/p>\n<p>materials   to   proceed   further   or   not   will   certainly   have   to   be<\/p>\n<p>considered   by   the   learned   Magistrate   at   the   stage   when   the<\/p>\n<p><span class=\"hidden_text\"> CRL.M.C.NO. 1717 OF 2007  -: 3 :-<\/span><\/p>\n<p>petitioner appears and the learned Magistrate thinks of reading<\/p>\n<p>over the particulars of the offence to the petitioner.<\/p>\n<p>        5.   If the learned Magistrate feels that there is no material<\/p>\n<p>to   justify   further   proceedings   against   the   accused   and   no<\/p>\n<p>offences are revealed particulars of which should be read over to<\/p>\n<p>the accused, needless to say, the  learned Magistrate can resort<\/p>\n<p>to   the   powers   under   Sec.258   of   the   Cr.P.C.   to   bring   about<\/p>\n<p>premature termination of the proceedings.<\/p>\n<p>        6.   This Crl.M.C. is, in these circumstances, dismissed; but<\/p>\n<p>with   the   specific   observation   that   the   dismissal   of   this   petition<\/p>\n<p>will   not   in   any   way   fetter   the   rights   of   the   petitioner   to   claim<\/p>\n<p>stopping of the proceedings under Sec.258 of the Cr.P.C.<\/p>\n<p>                                                         (R.
