1.     This appeal has been filed against the impugned judgment<\/p>\n
and decree dated 03.11.2010 which had endorsed the findings of<\/p>\n
the trial Judge dated 03.11.2009 wbereby the suit of the plaintiff<\/p>\n
Ashok Kumar seeking permanent injunction against the Municipal<\/p>\n
Corporation of Delhi (defendant No. 1) and MCD Slum & JJ Colony<\/p>\n
Department (defendant No. 2) was dismissed. This finding of the<\/p>\n
trial Judge was affirmed in the appeal Court.<\/p>\n
2      The plaintiff is stated to be the proprietor of Ashoka General

\n Store, Khokha No. 4, near Municipal Corporation Primary School,<\/p>\n
new Seelampur, Delhi. In 1962, the father of the plaintiff namely<\/p>\n
Daulat Ram had been allotted this khokha in terms of an allotment<\/p>\n
order dated 22.09.1976 (Ex. PW-1\/4); in lieu of a benefit of a<\/p>\n
sterilization scheme. The contention of the plaintiff was that his<\/p>\n
father Daulat Ram had participated in the sterilization scheme; he<\/p>\n
had voluntary tendered himself for sterilization; in view thereof he<\/p>\n
had been allotted this khokha. After the death of his father in 1986,<\/p>\n
the plaintiff Ashok Kumar was legally entitled to retain possession<\/p>\n
of this khokha. Reliance has been placed on Ex. PW-1\/4 to<\/p>\n
substantiate his submission that the act of the defendant in<\/p>\n
threatening to demolish this khokha is unwarranted; a decree of<\/p>\n
permanent injunction had been sought.\n<\/p>\n
3.    The defendants in their written statement had denied the<\/p>\n
contention raised by the plaintiff; defendant No. 1 had stated that<\/p>\n
the plaintiff is an encroacher upon the MCD land, MCD is legally<\/p>\n
entitled to remove this khokha. Stand of defendant No. 2 was also<\/p>\n
by and large same.\n<\/p>\n
4.    On the pleadings of the parties, the following five issues were<\/p>\n
framed:-\n<\/p>\n
      1      Whether the suit is not maintainable for want of
\n             statutory notice u\/s 477\/478 of the DMC Act? OPD.
\n      2      Whether the suit is without any cause of action and
\n             same is liable to be rejected u\/o7 Rule 11 CPC? OPD
\n      3      Whether this suit is bad for mis-joinder and non-joinder
\n             of necessary parties? OPD
\n      4      Whether the plaintiff is entitled for a decree of
\n             permanent injunction as prayed for? OPP.\n<\/p><\/blockquote>\n

       5.     Oral and documentary evidence was led by the<\/p>\n
      respective parties. The allotment letter dated 22.09.1976 had<\/p>\n
      been proved as Ex. PW-1\/4. Death certificate of the father of<\/p>\n
      the plaintiff had been proved as Ex. PW-1\/5. PW-2 had been<\/p>\n
      summoned from the Slum & JJ Department, MCD. PW-2 had<\/p>\n
      deposed that these colonies were developed by the DDA and<\/p>\n
      the plots were allotted by them; Slum & JJ Department did<\/p>\n
      not have any such policy as it is only managing these<\/p>\n
      colonies; the allotment as summoned is not available in their<\/p>\n
      office. Even in the subsequent statement of PW-2 recorded<\/p>\n
      pursuant to an application filed by the plaintiff seeking his<\/p>\n
      resummoning, he had deposed on oath that the copy of<\/p>\n
      allotment letters issued to Faqir Mohammad, Prabhati Lal,<\/p>\n
      Radheshyam and Hazmat Ali allotted under the sterilization<\/p>\n
      scheme was available; he had produced the record pertaining<\/p>\n
      to shops No.2, 3, 6, 9, 10, 11, 12, 13, 17, 18, 19 & 20; copy of<\/p>\n
      the allotment letters had been exhibited as Ex. PW-2\/3 to Ex.<\/p>\n
      PW-2\/7. The case of the plaintiff is that he had been allotted<\/p>\n
      Khokha No. 4 at New Seelampur. The record produced by<\/p>\n
      PW-2 was of Nehru Market; he had categorically stated that<\/p>\n
      this is only known as Nehru Market; he had denied the<\/p>\n
      suggestion that Nehru Market also known as Nasbandi<\/p>\n
      Market.\n<\/p><\/blockquote>\n
      6.     Admittedly the record which the plaintiff had sought to<\/p>\n
      prove could not be produced and had not been proved in the<\/p>\n
      version of PW-2. The Courts below had rightly held that the<\/p>\n
      plaintiff was claiming a discretionary and equitable relief of<\/p>\n
      injunction, he had to show some kind of a right or title to the<\/p>\n

\n       property before an injunction could be granted to him<\/p>\n
      especially in view of the stand of the defendants wherein they<\/p>\n
      had stated that the plaintiff is an encroacher simplicitor, on<\/p>\n
      the land of the Government. Admittedly, the land belonged to<\/p>\n
      the MCD.\n<\/p><\/blockquote>\n
      7.     Provisions of Sections 41 (h) and 38      of the Specific<\/p>\n
      Relief Act had also been adverted to as also the judgment<\/p>\n
      reported in AIR 2008 SC 2033 Anathula Sudhakar Vs. Buchi<\/p>\n
      Reddy.\n<\/p><\/blockquote>\n
      8.     In this case, there was a cloud over the title of the<\/p>\n
      plaintiff; he has failed to prove his legal right over the said<\/p>\n
      land rightly disentitling him to the relief of injunction. The<\/p>\n
      plaintiff had failed to show his interest qua the suit land. This<\/p>\n
      Court is not a third fact finding Court. It can interfere in the<\/p>\n
      findings of the court below only if the same are perverse. No<\/p>\n
      such perversity has been pointed out. Substantial questions<\/p>\n
      of law have been formulated at page 1. They all border on the<\/p>\n
      document Ex. PW-1\/4. This document had not been proved.<\/p>\n
      Both the courts below had rightly not granted the relief<\/p>\n
      prayed for by the plaintiff. No substantial question of law has<\/p>\n
      arisen.\n<\/p><\/blockquote>\n
      9.     Appeal as also pending applications are dismissed in<\/p>\n
      limine.\n<\/p><\/blockquote>\n
