Anita Devi, W\/o Mukesh Singh.\n                                           Versus\n                                     The State of Bihar\n                                       -----------------\n<\/pre>\n<p>02.   12.10.2011             Learned counsel for the petitioner is permitted to<\/p>\n<p>                    withdraw the application with regard to petitioners No. 1<\/p>\n<p>                    and 2 without prejudice to their case.\n<\/p>\n<p>                             Heard learned counsel for the petitioners and the<\/p>\n<p>                    State.\n<\/p>\n<p>                             The petitioners are apprehending their arrest in a<\/p>\n<p>                    case registered under Sections 341, 323, 324, 326, 307,<\/p>\n<p>                    379 and 504\/34 of the Indian Penal Code.\n<\/p>\n<p>                             Considering that the petitioner No. 3 is a lady, let<\/p>\n<p>                    the petitioner No. 3, above named be released on<\/p>\n<p>                    anticipatory bail in the event of arrest or surrender before<\/p>\n<p>                    the learned Court below within a period of four weeks<\/p>\n<p>                    from the date of receipt of the order on furnishing bail<\/p>\n<p>                    bond of Rs. 5,000\/- (Five Thousand) with two sureties of<\/p>\n<p>                    the like amount each or any other surety as fixed by the<\/p>\n<p>                    Court to the satisfaction of Chief Judicial Magistrate,<\/p>\n<p>                    Samastipur in connection with Patori P.S. Case No. 138 of<\/p>\n<p>                    2010 subject to the conditions as laid down under Section<\/p>\n<p>                    438(2) of the Code of Criminal Procedure as also subject<\/p>\n<p>                    to the following conditions:- (i) That one of the bailors will<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>           be a close relative of the petitioner who will give an<\/p>\n<p>           affidavit giving genealogy as to how he is related with the<\/p>\n<p>           petitioner. The bailor will also undertake to inform the<\/p>\n<p>           Court if there is any change in the address of the<\/p>\n<p>           petitioner. (ii) That the affidavit shall clearly state that the<\/p>\n<p>           petitioner is not an accused in any other case and if she is<\/p>\n<p>           she shall not be released on bail. (iii) That the bailor shall<\/p>\n<p>           also state on affidavit that he will inform the court<\/p>\n<p>           concerned if the petitioner is implicated in any other case<\/p>\n<p>           of similar nature after her release in the present case and<\/p>\n<p>           thereafter the court below will be at liberty to initiate the<\/p>\n<p>           proceeding for cancellation of bail on the ground of<\/p>\n<p>           misuse. (iv) That the petitioner will give an undertaking<\/p>\n<p>           that she will receive the police papers on the given date<\/p>\n<p>           and be present on date fixed for charge and if she fails to<\/p>\n<p>           do so on two given dates and delays the trial in any<\/p>\n<p>           manner, her bail will be liable to be cancelled for reasons<\/p>\n<p>           of misuse.
