ORAL JUDGEMENT<\/p>\n
     This petition was admitted to final hearing on
\n     6th September, 1996 and the respondents were directed to
\n     file their affidavit in reply to the petition, if any, on
\n     or before 31st December, 1996. Today when the matter is
\n     taken up for hearing, neither of the respondents has
\n     filed its affidavit in reply to the petition nor the
\n     learned   advocate   appearing for the respondents is
\n     present.\n<\/p>\n
 The   petitioner   herein is    an    Assistant
\nCommissioner of Labour who has claimed deemed promotion
\nto the post of Assistant Commissioner of Labour with
\neffect from 23rd April, 1982. The facts leading to the
\npetition are as under :\n<\/p>\n
Under order dated 26th      August,   1969,    the
\npetitioner was appointed as Government Labour Officer.
\nHis seniority vis-a-vis other Government Labour Officers
\nwas determined on the basis of continuous officiation.
\nUnder the provisional seniority list published on 8th
\nSeptember, 1981, the petitioner appeared junior to one
\nShri Bhansali and Shri Dave. Said Shri Bhansali and Shri
\nDave were promoted to the post of Assistant Labour
\nCommissioner on 23rd April, 1982. The petitioner applied
\nfor direct recruitment to the post of Assistant Labour
\nCommissioner and having been selected was appointed as
\nAssistant Labour Commissioner on 8th December, 1983. The
\nprovisional seniority list of the Government Labour
\nOfficers was revised and published under Government
\nCircular dated 19th December, 1983. Under the said list
\n(Annexure “B” to the petition), the seniority of the
\nGovernment Labour Officers was arranged in accordance
\nwith the statutory quota for direct recruitment and
\npromotion.    The petitioner therein has been shown to be
\nsenior to the above referred Shri Bhansali and Shri Dave.
\nThe said seniority list was finalised under Government
\nCircular dated 18th December, 1989 and the petitioner
\nretained his seniority over said Shri Bhansali and Shri
\nDave in the final seniority list also.          Thus, the
\npetitioner’s position in the cadre of Government Labour
\nOfficer    having   become  crystallized,   he     made   a
\nrepresentation to the Government to grant him deemed
\npromotion to the post of Assistant Commissioner of Labour
\nwith effect from 23rd April, 1982, the date on which Shri
\nBhansali and Shri Dave were promoted. He also requested
\nthat he may be treated as having been promoted to the
\npost of Assistant Commissioner of Labour and be treated
\nas promotee Assistant Commissioner of Labour.      Pursuant
\nto the representation and the reminders sent by the
\npetitioner, the Government under its communication dated
\n28th June, 1995 inquired of the petitioner whether he
\nwanted to opt for being treated as promotee Assistant
\nCommissioner    instead of a Direct Recruit Assistant
\nCommissioner. The petitioner under his reply dated 10th
\nJuly, 1995 submitted his option to be treated as promotee
\nAssistant Commissioner of Labour and claimed that he be
\ngiven deemed promotion with effect from 23rd April, 1982,
\nthe date on which Shri Bhansali and Shri Dave were so
\npromoted.    Since then the petitioner has sent several
\nreminders, however, the     option   submitted     by   the
\n petitioner under his communication dated 10th July, 1995
\nhas not been decided till the date.\n<\/p>\n
The   facts   stated   in   the   petition    are
\nsubstantiated by the relevant seniority lists which are
\nproduced at Annexures “A”, “B” and “C” to the petition.
\nIt does not appear to be fair that the Government, having
\ngiven option to the petitioner for being treated as
\npromotee Assistant Commissioner of Labour, has not taken
\nany decision on the option submitted by him. Even after
\nfiling of this petition, the Government has not cared to
\nfile any affidavit in reply to the petition.           The
\npetition, therefore, requires to be allowed.           The
\nGovernment is directed to consider the option given by
\nthe petitioner on 10th July, 1995 and communicate its
\ndecision to the petitioner as soon as possible but not
\nbeyond eight weeks from the date of receipt of copy of
\nthis order.    In the event the petitioner’s option for
\nbeing treated as promotee Assistant Commissioner of
\nLabour is accepted, the petitioner’s claim for deemed
\npromotion with effect from 23rd April, 1982 shall be
\nconsidered in accordance with law and if the petitioner
\nis otherwise found to be eligible and fit for promotion,
\nhe be given deemed date of promotion as that of 23rd
\nApril, 1982. In that eventuality, the petitioner shall
\nbe entitled to revision of his pay with effect from date
\nof the deemed promotion.     However, he shall not be
\nentitled to claim actual difference of salary from the
\ndate of deemed promotion till the date of          actual
\npromotion. It is further clarified that in that case the
\npetitioner   shall   be treated as promotee Assistant
\nCommissioner of Labour for all purposes and he shall not
\nbe entitled to claim any benefit of being direct recruit
\nAssistant Commissioner of Labour. The aforesaid exercise
\nof considering the petitioner’s case for deemed promotion
\nand giving of other consequential benefits shall be
\ncompleted as expeditiously as possible.       Petition is
\nallowed to the aforesaid extent. Rule is made absolute.
\nThe respondents shall bear the costs of this petition.\n<\/p>\n
