M.A. No. 1083 of 2010\n                -----------------------------------------\n\n         Dated this the 1st day of February, 2010\n\n\n                             O R D E R\n<\/pre>\n<p>     This is an application filed under Section 147 of the<\/p>\n<p>Negotiable Instruments Act for compounding the offence<\/p>\n<p>under Section 138 of the Negotiable Instruments act in<\/p>\n<p>which the revision petitioner is involved. It is stated that<\/p>\n<p>the matter has been settled out of court and the<\/p>\n<p>complainant has received the amount due from the<\/p>\n<p>revision petitioner and therefore the complainant is not<\/p>\n<p>intend to proceed with the case further. This compound<\/p>\n<p>petition is signed by both the revision petitioner as well<\/p>\n<p>as the complainant and counter signed by their<\/p>\n<p>prospective counsels. As I am satisfied with the reasons<\/p>\n<p>stated   in   the    petition,       this     petition    is allowed<\/p>\n<p>compounding the offence.\n<\/p>\n<\/p>\n<p>                                     V.K. No. 376 of 2010\n<\/p>\n<p>                &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;<br \/>\n         Dated this the 1st day of February, 2010<\/p>\n<p>                            O R D E R<\/p>\n<p>     The revision petitioner is the sole accused in ST No.<\/p>\n<p>1036\/2006,   approached          this     court      challenging   his<\/p>\n<p>conviction under Section 138 of Negotiable Instruments<\/p>\n<p>Act and the sentence imposed against him. The trial<\/p>\n<p>court on conviction sentenced him to under go simple<\/p>\n<p>imprisonment for     one month and also                directed to pay<\/p>\n<p>Rs. 80,000\/- to the complainant as compensation.                    In<\/p>\n<p>appeal by judgment dated 22-04-2009 the appellate court<\/p>\n<p>modified the sentence and directed the accused to<\/p>\n<p>undergo imprisonment till rising of the court for one day<\/p>\n<p>and to pay a sum of Rs. 80,000\/- as compensation under<\/p>\n<p>section 357(3) Cr.PC.              It is the above judgment,<\/p>\n<p>conviction and sentence            challenged in this revision<\/p>\n<p>petition.\n<\/p>\n<p>     While the revision petition is pending before this<\/p>\n<p>court the matter has been settled out of the court and the<\/p>\n<p>parties approached this court by filing a compound<\/p>\n<p>petition wide Crl.M.A No. 1083\/2010 and this court by a<\/p>\n<p>separate order allowed this application. In the light of the<\/p>\n<p>above order, this Criminal Revision Petition can be<\/p>\n<p>disposed of .\n<\/p>\n<\/p>\n<p>     In the result this Crl. RP is allowed setting aside the<\/p>\n<p>judgment of the court below and acquitting the accused.<\/p>\n<p>Accordingly this Criminal Revision Petition is allowed as<\/p>\n<p>above.\n<\/p>\n<\/p>\n<p>                                    V.K.
