HEMA, J.\n        - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n                        B.A. No.7483 of 2008\n        - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n          Dated this the 19th day of December,2008\n\n                                 O R D E R\n<\/pre>\n<p>       Petition for bail.\n<\/p>\n<p>       2. The alleged offence is under section 395 IPC.<\/p>\n<p>According to      prosecution,        1st accused pointed out de facto<\/p>\n<p>complainant to 2nd accused who, thereafter, pointed him to<\/p>\n<p>accused 3 to 5. Those people arranged accused nos. 6 to 9 to<\/p>\n<p>robbery and by snatching away Rs.26 lakhs which is hawala<\/p>\n<p>money.\n<\/p>\n<p>       3. Petitioners are accused nos.1 and 3. They were<\/p>\n<p>arrested on 25-10-2008. Learned counsel for petitioners<\/p>\n<p>submitted that even as per the prosecution case, petitioners&#8217;<\/p>\n<p>role is only in pointing out de facto complainant to others who<\/p>\n<p>are actually involved in the commission of offence.<\/p>\n<p>       4. Learned Public Prosecutor submitted that he has no<\/p>\n<p>objection in granting bail but stringent conditions may be<\/p>\n<p>imposed.\n<\/p>\n<p>       5. Hence, petitioners shall be released on bail on their<\/p>\n<p>executing a bond for Rs.25,000\/- each with two solvent sureties<\/p>\n<p>each for the like amount to the satisfaction of the learned<\/p>\n<p>Magistrate, on the following conditions:-<\/p>\n<p>             1)     Petitioners       shall     report      before      the<\/p>\n<p>BA 7483\/08                       -2-\n<\/p>\n<blockquote><p>                 Investigating Officer on every Monday,<\/p>\n<p>                 Wednesday     and Saturday between        10<\/p>\n<p>                 a.m. and 1 p.m. until further orders.<\/p>\n<\/blockquote>\n<blockquote><p>           2) Petitioners shall not leave the limits of the<\/p>\n<p>                 police station within which the crime is<\/p>\n<p>                 registered    except    with   the     prior<\/p>\n<p>                 permission of the learned Magistrate.<\/p>\n<\/blockquote>\n<blockquote><p>           3) Petitioners shall not intimidate or influence<\/p>\n<p>                 any witness or tamper with evidence or<\/p>\n<p>                 commit any offence while on bail and in<\/p>\n<p>                 case breach of this condition, bail is liable<\/p>\n<p>                 to be cancelled.\n<\/p><\/blockquote>\n<blockquote><p>      This petition is allowed.\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>                                           K.HEMA, JUDGE.\n<\/p><\/blockquote>\n<p>mn.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Saidalavi vs State Of Kerala Represented By The on 19 December, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 7483 of 2008() 1.
