PUBLIC PROSECUTOR for\nRespondent(s) : 1, \n=========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\nDate\n: 17\/02\/2011\n \n\nORAL\nORDER<\/pre>\n<p>By<br \/>\n\tway of present application filed under Section 389 of the Code of<br \/>\n\tCriminal Procedure, 1973, the applicant has inter alia prayed to<br \/>\n\tenlarge him on bail pending the appeal suspending the judgment and<br \/>\n\torder of sentence dated 05th January 2011 passed by the<br \/>\n\tlearned Additional Sessions Judge, Fast Track Court No.3, Gondal in<br \/>\n\tSessions Case No.142 of 2008.\n<\/p>\n<p>Heard<br \/>\n\tMr.Satyam Chhaya, learned counsel for the applicant and Mr.H.L.<br \/>\n\tJani, learned Additional Public Prosecutor for the respondent-State.\n<\/p>\n<p>Mr.Chhaya<br \/>\n\thas contended that there are contradiction in the oral evidence of<br \/>\n\tthe prosecutrix and complainant. He has also contended that the<br \/>\n\tprosecutrix is not minor at the event of incident in question. He<br \/>\n\thas also contended that this is a case of consent. He has also<br \/>\n\tcontended that the applicant is a young boy aged 20 years. He has<br \/>\n\tfurther contended that the applicant is on bail during the trial. He<br \/>\n\thas also contended that there are certain love letters, which are<br \/>\n\tthe part of the charge-sheet to show that this is a case of consent.<br \/>\n\tHe, therefore, contended that looking to the overall facts and<br \/>\n\tcircumstances of the case, present application is required to be<br \/>\n\tallowed and applicant is required to be enlarged on bail.\n<\/p>\n<p>As<br \/>\n\tagainst this, Mr.Jani has read the judgment and order passed by the<br \/>\n\tlearned trial Judge and contended that the order passed by the<br \/>\n\tlearned Judge is absolutely just and proper and no interference is<br \/>\n\trequired to be called for. He has contended that the applicant has<br \/>\n\tforcibly taken the prosecutrix with him. He has also contended that<br \/>\n\tthe applicant has threatened the prosecutrix and because of the fear<br \/>\n\tonly, the prosecutrix gone with the applicant. He has also contended<br \/>\n\tthat medical certificate is also supported the case of the<br \/>\n\tprosecutrix. He has also contended that the applicant has committed<br \/>\n\tserious offence against her wish and will and therefore, present<br \/>\n\tapplication deserves to be dismissed.\n<\/p>\n<p>I<br \/>\n\thave perused the papers produced before me as well as submissions<br \/>\n\tadvanced by the learned counsel for the parties. Looking to the<br \/>\n\tpapers, it appears that prosecutrix was threatened by the applicant<br \/>\n\tand therefore, under the threat, the prosecutrix had gone with the<br \/>\n\tapplicant. It also appears from the papers that the prosecutrix was<br \/>\n\ttempted and by force and against her wish and will, the applicant<br \/>\n\thas committed rape. Even, medical certificate is also supported the<br \/>\n\tcase of the prosecution.\n<\/p>\n<p>In<br \/>\n\tview of above, I am of the opinion that present application deserves<br \/>\n\tto be dismissed and is hereby dismissed.\n<\/p>\n<p>(Z.\n<\/p>\n<p>K.
