By<br \/>\nthe said order,  the revision application of the present petitioners<br \/>\nagainst the order passed by the Collector came to be rejected.  Issue<br \/>\npertains to entries in the revenue record of the land bearing block<br \/>\nNo.167 of village Palod, Tal: Mangrol which the petitioners had<br \/>\npurchased.\n<\/p>\n<p>3.\tIt<br \/>\nis not in dispute that with respect to the land in question,<br \/>\nMamlatdar and ALT had initiated proceedings under section 84C of the<br \/>\nTenancy Act and the order passed by the Mamlatdar and ALT  thereon on<br \/>\n7.7.97 was confirmed by the Deputy Collector by the order dated<br \/>\n6.7.99.  Against these orders, the petitioners had preferred revision<br \/>\napplication before the Gujarat Revenue Tribunal.  The Gujarat Revenue<br \/>\nTribunal disposed of the revision application  by decision dated 6th<br \/>\nOctober, 2004 reversing the orders of the Mamlatdar and the Deputy<br \/>\nCollector.\n<\/p>\n<p>4.\tIt<br \/>\nappears that the order passed by the Gujarat Revenue Tribunal   was<br \/>\nnot placed on record before the Secretary (Appeals).  In the impugned<br \/>\norder, therefore, he observed that the petitioners have not produced<br \/>\nany details about the final outcome of the revision application which<br \/>\nwas filed by them before the Gujarat Revenue Tribunal challenging the<br \/>\norders passed by the Mamlatdar and the Deputy Collector. He,<br \/>\ntherefore, provided that when the transfers have been declared  as<br \/>\nillegal, it would not be appropriate to restore the entires in favour<br \/>\nof the petitioners, however, ultimately as per the decision of the<br \/>\nGujarat Revenue Tribunal,  corresponding entries will be made in the<br \/>\nrevenue records.\n<\/p>\n<p>5.\tIt<br \/>\nis true that it was the duty of the petitioners to bring on record<br \/>\nthe decision of the Gujarat Revenue Tribunal dated 6th<br \/>\nOctober,2004 before the Secretary (Appeals).  This does not appear to<br \/>\nhave been done.  However, on account of this  lapse, the petitioners<br \/>\ncannot be made to suffer permanently. When the Secretary himself had<br \/>\nprovided in the impugned order that  ultimate entries will be made in<br \/>\nthe revenue records as per the outcome of the revision application<br \/>\nbefore the Gujarat Revenue Tribunal and when I find that the Tribunal<br \/>\nhas already allowed the revision application of the petitioners and<br \/>\nreversed the orders passed by the Mamlatdar and the Deputy Collector<br \/>\nwith respect to 84C proceedings, it is appropriate that the Mamlatdar<br \/>\nshould carry out the correction in the records pursuant to the<br \/>\ndecision of the Gujarat Revenue Tribunal.\n<\/p>\n<p>6.\tAccordingly,<br \/>\nit is directed that the Mamlatdar shall give effect to the decision<br \/>\nof the Gujarat Revenue Tribunal dated 6th October, 2004 by<br \/>\nmaking appropriate  entries in the revenue record of the land in<br \/>\nquestion.
