Advocate,Sushil Chandra Srivastava\n\nHon'ble Sheo Kumar Singh,J.\n<\/pre>\n<p>Hon&#8217;ble Shyam Shankar Tiwari,J.\n<\/p>\n<p>Heard Sri R.P. Srivastava, learned Advocate appeared to press bail<br \/>\napplication moved on behalf of appellants Rajneesh s\/o<br \/>\nParashuram and Parashuram s\/o Ram Naresh Chaudhary. Sri<br \/>\nSushil Chandra Srivastava appeared for the informant is also heard<br \/>\nand learned Additional Government Advocate for the State.\n<\/p>\n<p>Submission is that admittedly it is night incident and even if the<br \/>\nprosecution version is accepted the role of fire is given\/assigned to<br \/>\nRam Bahadur @ Kaushal and so far these appellants are concerned<br \/>\nthe only allegation is that they were seen while running after the<br \/>\nfire of the deceased.\n<\/p>\n<p>Submission is that the finding of the learned Trial Judge that there<br \/>\nwas no source of light on the spot and it is after the incident the<br \/>\nwitnesses wake up and they saw the accused persons running in<br \/>\nthe torch light.\n<\/p>\n<p>Submissions is that it is a case of single shot and thus after the fire<br \/>\nif some body was sleeping at nearby place, in the torch light it is<br \/>\nnot possible to see the actual commission of the offence so as to<br \/>\nclearly states that who had commit the offence, so far appellant<br \/>\nconcerned are entitled to be enlarged on bail.\n<\/p>\n<p>In response of the aforesaid Sri Sushil Chandra Srivastava and<br \/>\nlearned Additional Government Advocate submits that although it<br \/>\nis night incident, prompt report and witnesses are there who saw<br \/>\nthe accused persons running after committing the offence, so far as<br \/>\nit not a case of grant of bail.\n<\/p>\n<p>On a perusal of the facts and finding so recorded it is clear that on<br \/>\nthe spot no source of light was found and the finding is that after<br \/>\nthe incident witnesses saw the accused running and it was seen in<br \/>\nthe torch light. It is case of single fire and thus after commission of<br \/>\nthe offence even if the witnesses saw the other co-accused namely<br \/>\nRam Bahadur @ Kaushal then so far the appellants are concerned<br \/>\n the role remain only of exhortation.\n<\/p>\n<p>Submission is that appellant were on bail during and they did not<br \/>\nmisuse the same and the appeal is not so old and thus it will take<br \/>\nlong time in its disposal, thus the appellants are entitled to be<br \/>\nenlarged on bail.\n<\/p>\n<p>On the facts and totality of the circumstances this Court of the<br \/>\nconsidered view that the appellants are entitled to be enlarged on<br \/>\nbail.\n<\/p>\n<p>Accordingly, let the appellants Rajneesh and Parashuram involved<br \/>\nin S.T. No.1 of 2008, be enlarged on bail on their furnishing<br \/>\npersonal bond and two sureties each in the like amount to the<br \/>\nsatisfaction of the Court concerned.\n<\/p>\n<p>Realization of fine in respect to above appellants to the extent of<br \/>\nfifty percent shall remain stayed. Balance amount of fine shall be<br \/>\ndeposited forthwith.
