The Court below is<br \/>\nalso directed to give due priority to decide the said suits, as<br \/>\nexpeditiously as possible, preferably within a period of six months<br \/>\nfrom today.  Rule made absolute to the aforesaid extent.&#8221;\n<\/p>\n<p>3.\t\tLearned<br \/>\nAdvocate for the applicant submitted that after this order was<br \/>\npassed, the present applicant was impleaded as defendant in Special<br \/>\nCivil Suit No.26 of 2009 on 13.05.2011.  It is thereafter that the<br \/>\npresent applicant filed an application under Section 10 of Code of<br \/>\nCivil Procedure.  That application is rejected only on the ground<br \/>\nthat this Court by the aforesaid order has directed that both the<br \/>\nsuits be heard together and decided by the learned Judge with due<br \/>\npriority, preferably within a period of six months from the date of<br \/>\nthe order.\n<\/p>\n<p>3.1\t\tLearned<br \/>\nAdvocate for the applicant submitted that on 04.05.2010, when this<br \/>\nCourt passed an order, the Court never wanted to deprive the present<br \/>\napplicant of his right flowing from Section 10 of Code of Civil<br \/>\nProcedure.\n<\/p>\n<p>4.\t\tLearned<br \/>\nAdvocate for respondent No.2 submitted that as the plaintiff of<br \/>\nSpecial Civil Suit NO.26 of 2009 is also claiming right over the<br \/>\nsubject matter of the suits, no prejudice will be caused to the<br \/>\nplaintiff of Special Civil Suit NO.23 of 2009.\n<\/p>\n<p>5.\t\tThe<br \/>\nquestion which falls for consideration of this Court is as to whether<br \/>\non 04.05.2010, this Court wanted the present applicant to be deprived<br \/>\nof a right flowing in his favour from Section 10 of Code of Civil<br \/>\nProcedure and the answer is in negative.\n<\/p>\n<p>6.\t\tThat<br \/>\nbeing so, it is clarified that when the Court directed that both the<br \/>\nsuits (Special Civil Suit No.26 of 2009 and  Special Civil Suit No.23<br \/>\nof 2009) be heard together and decided by the learned Judge with due<br \/>\npriority, preferably within a period of 6 months from the date of<br \/>\nthat order, the Court never wanted the present applicant to be<br \/>\ndeprived of his right flowing from Section 10 of Code of Civil<br \/>\nProcedure.\n<\/p>\n<p>7.\t\tThe<br \/>\napplication is disposed of with the aforesaid observations.\n<\/p>\n<p>\t\tAt<br \/>\nthe request of learned Advocate Mr.Majmudar for respondent No.1, it<br \/>\nis clarified that this Court has not examined the question of<br \/>\napplicability of Section 10 of Code of Civil Procedure to the fact of<br \/>\nthe case or merits of application Exh.47.\n<\/p>\n<p>(Ravi<br \/>\nR.Tripathi, J.)<\/p>\n<p>*Shitole<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Chandulal vs Heard on 7 September, 2011 Author: Ravi R.Tripathi, Gujarat High Court Case Information System Print MCA\/2078\/2011 3\/ 3 ORDER IN THE HIGH COURT OF GUJARAT AT AHMEDABAD MISC.CIVIL APPLICATION-CLARIFICATION OF ORDER No. 2078 of 2011 In SPECIAL CIVIL APPLICATION No. 5537 of 2009 ===================================================================== CHANDULAL NANJIBHAI DAMA &#8211;
