GOVERNMENT PLEADER for\nRespondent(s) : 1, \nNone for Respondent(s) : 2 -\n3. \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE S.R.BRAHMBHATT\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 20\/10\/2011 \n\n \n\n \n \n\n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tAppropo<br \/>\nan order passed on 10.10.2011, the learned advocate for the<br \/>\npetitioner has prayed for either hearing of the matter finally or<br \/>\nsome relief in the nature of protection.\n<\/p>\n<p>2.\tLearned<br \/>\nAssistant Government Pleader is also ready for the final disposal of<br \/>\nthe matter.\n<\/p>\n<p>3.\tThis<br \/>\nCourt is not inclined to hear the matter for final disposal today,<br \/>\ndue to paucity of time. Hence, let there be a notice, returnable on<br \/>\n14.11.2011. In the meantime  and till the returnable date, status-quo<br \/>\nshall be maintained by all the concerned. This status-quo order is<br \/>\nrequired to be made as this Court has observed on 30.09.2011 as<br \/>\nunder:\n<\/p>\n<p>This Court on 29\/8\/2011 passed<br \/>\n\tthe following order.\n<\/p>\n<p>&#8220;1.\n<\/p>\n<p>\tLeave to amend by deletion of averment in respect of annexing<br \/>\n\tdocument which could not be annexed.\n<\/p>\n<p>2.<br \/>\n\tThe petitioner has made averments in para no. 29, 30 and 31 of the<br \/>\n\tpetition, indicating that the petitioner filed petition being<br \/>\n\tSpecial Civil Application No. 18817 of 2006, wherein this Court was<br \/>\n\tpleased to pass order on 5\/10\/2006, pursuant whereof representation<br \/>\n\twas made which was received by the Revenue department on 12\/10\/2006,<br \/>\n\tand that has so far not been decided as could be seen from the<br \/>\n\taverments in para no. 31.\n<\/p>\n<p>3.<br \/>\n\tMs. Pathak, learned AGP to take specific instruction in this behalf<br \/>\n\tas to whether the representation is received, and if yes, how has it<br \/>\n\tbeen dealt with and for that purpose the matter is kept on 2\/9\/2011.\n<\/p>\n<p>4.<br \/>\n\tOffice is directed to make available copy of this order to learned<br \/>\n\tAGP for its compliance.&#8221;\n<\/p>\n<p>\tThus,<br \/>\nthe observations made in this order unequivocally go to show that<br \/>\nlearned AGP was to receive specific instructions as to whether the<br \/>\nrepresentation dated 12\/10\/2006 is received, and if yes, then how<br \/>\nthat representation was dealt with, and for that purpose matter was<br \/>\nadjourned to 2\/9\/2011.\n<\/p>\n<p>The<br \/>\n\taffidavit-in-reply is filed by one gentleman, namely Mr. Dipak C.<br \/>\n\tSonawala, I\/c. Addl. Mamlatdar &amp; ALT, Chorayasi, Sutat. This<br \/>\n\taffidavit is affirmed on 23\/9\/2011. Said affidavit-in-reply does not<br \/>\n\tcontain anywhere even remotely any reference to the representation<br \/>\n\ttalked about in para-2 of the order dated 29\/8\/2011. The<br \/>\n\trepresentation was admittedly made to the Revenue Secretary and<br \/>\n\tinstructions ought to have been received from the State in the<br \/>\n\tRevenue Department. The inaction on the part of the respondent,<br \/>\n\tdespite there being an order on 29\/8\/2011 is indeed unfortunate and<br \/>\n\tleaves this Court with no other option but to now make specific<br \/>\n\torder directing the Secretary, Revenue Department to issue specific<br \/>\n\tinstruction in respect of the observations made in order dated<br \/>\n\t29\/8\/2011, which is set out in this order itself and the said<br \/>\n\taffidavit is to be filed on or before 7\/10\/2011, failing which it<br \/>\n\twill be presumed that the officer at the level of Mamlatdar do not<br \/>\n\tact in accordance with the final opinion expressed by the State<br \/>\n\tauthorities in respect of the land in question and the appropriate<br \/>\n\torder will be passed.\n<\/p>\n<p>It is reiterated<br \/>\n\tat the cost of repetition that the Revenue Secretary has to file<br \/>\n\taffidavit precisely on the observation with regard to the action<br \/>\n\ttaken on the representation dated 12\/10\/2006.  The office is<br \/>\n\tdirected to supply copy of this order to learned AGP, on demand,<br \/>\n\timmediately for its onward transmission for compliance.\n<\/p>\n<p>At this stage, it<br \/>\n\tis also contended on the part of the petitioners that the<br \/>\n\tunfortunate part is that, though there is clear finding by the<br \/>\n\tconcerned Mamlatdar &amp; ALT dated 31\/8\/2009 that the land is not<br \/>\n\tfalling under the purview of provision of Bombay Tenancy &amp;<br \/>\n\tAgricultural Lands Act, 1948, the Incharge Addl. Mamlatdar &amp; ALT<br \/>\n\tis filing an affidavit contrary to the stand expressed by the<br \/>\n\tcompetent authority at the relevant time.\n<\/p>\n<p>Be that as it<br \/>\n\tmay, the Revenue Secretary is hereby directed to comply with the<br \/>\n\torder. Adjourned to 7\/10\/2011.&#8221;\n<\/p>\n<p>\tThe<br \/>\nreasonings indicating in the order dated 30.09.2011 is the reasonings<br \/>\nfor passing the order of status-quo.
