By consent of both the<br \/>\ncounsel, the writ petition itself is taken up for final hearing.\n<\/p>\n<p>\t2. This writ petition has been filed for a direction forbearing the<br \/>\nrespondents 1 to 4 from preventing the petitioner&#8217;s Yogeeswarar Community from<br \/>\nconducting 13th day Mandagapadi every year in the Tamil month of &#8216;Thai&#8217; in Ther<br \/>\nThiruvizha of Arulmugu Muppidariyammon and Kallaga Naadiyamman Temple situated<br \/>\nat Krishnapuram Village, Kadayanallur, Tenkasi Taluk, Tirunelveli District.\n<\/p>\n<p>\t3. It is seen from the records that originally the Yogeeswarar Community<br \/>\npeople and the Velar Community have jointly used to celebrate the Arulmigu<br \/>\nMuppidari Amman and Arulmigu Kallanganadi Amman for 2nd day function.  Conflicts<br \/>\narose in between the petitioner&#8217;s community people and the Velar Community<br \/>\npeople in the year 1996 and one represented the by the petitioner and another<br \/>\none by 5th respondent.  As a temporary measure, the settlement was arrived at in<br \/>\nthe year 1996, in the presence of third respondent\/Assistant Commissioner,<br \/>\nH.R.&amp;C.E Department, Tirunelveli who has passed an order on 19.01.1996 having<br \/>\neffect that the Velar community people were conducting of the 2nd day<br \/>\nMandagapadi peacefully without hindrance in the year 1996.  But, in the year<br \/>\n1997, there was a split in the petitioner community.  The petitioner community<br \/>\npeople were to celebrate 13th day Mandagapadi which they have been doing till<br \/>\ndate.  However, as against the order of the third respondent, both the<br \/>\npetitioner as well as the 5th respondent have filed separate applications before<br \/>\nthe second respondent in O.A.Nos.1\/97 &amp; 11\/98. The second respondent has allowed<br \/>\nthe applications filed by the fifth respondent and setting aside the order of<br \/>\nthe third respondent allotting 13th day Mandagapadi to Yageeswarar Community<br \/>\npeople by its order dated 08.02.2005.\n<\/p>\n<p>\t4. Aggrieved, the petitioner group of Yogeeswarar Community have preferred<br \/>\nan appeal in A.P.No.7\/2005, which is  pending.  Though, the petitioner sought<br \/>\nfor specific order from the first respondent, the first respondent refused to<br \/>\ngrant an interim measure allowing them to celebrate 13th day Mandagapadi without<br \/>\nany hindrance to other community people. Hence, taking advantage, the fifth<br \/>\nrespondent approached the fourth respondent and instigated him to prevent the<br \/>\npetitioner&#8217;s community from conducting    13th day Mandagapadi, after receipt of<br \/>\nMandagapadi Kattalai.\n<\/p>\n<p>\t5. The petitioner submits that since 1996 they are regularly celebrating<br \/>\nand conducting 13th Mandagapadi individually without disturbing anybody.  The<br \/>\nfifth respondent is attempting to conduct the 13th day Mandagapadi.  Hence the<br \/>\npresent Writ petition has been filed.\n<\/p>\n<p>\t7. On the facts and circumstances of the case, this Court will not<br \/>\ninterfere with the order passed by the respondents. The first respondent alone<br \/>\nis to decide all the issues arising out on the order of the second respondent,<br \/>\nbeing the statutory appellate authority.\n<\/p>\n<p>\t7. Therefore, on the face of it the writ petition is not maintainable and<br \/>\nis liable to be dismissed. It is always open to the petitioner to move before<br \/>\nthe first respondent and seek for an interim direction in respect of the 13th<br \/>\nday celebration and in that event, the first respondent shall dispose of the<br \/>\nsame and pass suitable orders as expeditiously as possible, in accordance with<br \/>\nlaw and on merits.\n<\/p>\n<p>\t8. In view of the above observation, the Writ Petition is dismissed.<br \/>\nConsequently, the connected WPMP is closed.
